קושית הגמרא היא בהנחה שהניחו כי דרשת רבי ישמעאל: בן ולא אב, ומאמר רבי כרוספדאי: כל ימיו של בן סורר ומורה אינו אלא שלשה חדשים, הם שני דברים, לכן הקשו, איך אפשר בתוך שלושה חדשים לעבר אשה ולהוליד.

ומתרצת הגמרא, שמאמר רבי כרוספדאי הוא אכן דרשת רבי ישמעאל, כלומר, קטן אינו מוליד, והתורה לא באה למעט בן שכבר הוליד כי אינו במציאות. אלא ממעטת ומגבילה את הזמן לשלושה חדשים, שהוא הזמן שאם אשתו מעוברת - עיבורה ניכר עליה, כי ההכרה היא אחרי שלשה חדשים. וגזירת הכתוב היא, שאם עברה עליו תקופה שאורכה כמתחילת הריון עד הכרת העובר פטור , ומכאן המקור למאמר רבי כרוספדאי.

רבי כרוספדאי אמר שאשה שימי עיבורה הם תשעה חדשים, ניכר עוברה בסוף חודש השלישי.

הגמרא דנה, באשה שימי עיבורה הם שבעה חדשים , בכמה זמן ניכר עוברה, האם בשלשה חדשים כבכל אשה, או שליש ימי עיבורה שהם שני חדשים ושליש, כשם שהיולדת לתשעה ניכר עוברה בשליש ימי עיבורה.

ויש בכך נפקא מינה להלכה: אשה צריכה - מתקנת חז"ל - להשהות נישואיה בין בעל לבעל שלשה חדשים, ["ימי הבחנה"] כדי להבחין בזרעה שיוולד לה, אם הם בני הראשון או השני. כי אם לא תשהה, הולד שיוולד לה, לא יוודע בנו של מי הוא, ויש לכך השלכות להרבה דיני תורה. וכשתשהה שלשה חדשים יוכר עליה עיבורה אם היא מעוברת מהראשון, ואת אי - עיבורה מהראשון אם אינה מעוברת ממנו.

אשה שעברה על תקנת חכמים ולא שהתה ונשאה ונתעברה, והוכר עוברה אחרי שני חדשים ושליש מנשואיה מהשני וילדה בתום שבעה חדשים מנשואיה להשני. מעתה, אם הכרת העובר של יולדת לשבעה היא לשני חדשים ושליש, הרי הולד ספק מן השני ספק מן הראשון. אבל אם הכרת העובר היא אחרי שלשה חדשים, אין כאן ספק, והולד הוא ודאי מן הראשון.

כלומר, אם התורה אמרה, מדרשת רבי ישמעאל, שימיו הם מתקופת היותו ראוי להוליד עד תקופת היותו ראוי להכרת העובר, למה לא נצמצם את זמן הזה בהתאם ליולדת לשבעה. הרי התורה לא קבעה "זמן" אלא תקופה, ולמה לא ניחס תקופה זו להאפשרות ש"אם" היה מעבר אשה היולדת לשבעה, היה ניכר עוברה בפחות משלושה חדשים.

אלא, משמע שגם יולדת לשבעה - הכרת עוברה היא לשלשה חדשים.

[ולפי דברים אלו יוצא שלצד שהעובר ניכר לשני חדשים ושליש, אם בן סורר ומורה יעשה מעשיו המכוערים בשני שלישי חדש השלישי של אחרי הבאת שתי שערות, לא ייעשה בן סורר ומורה.]

רבינא לרב יעקב מנהר פקוד: אין הוכחת רב הונא בריה דרב יהושע הוכחה, כי

באמת אפשר לומר: יולדת לשבעה

ובכל זאת אם יעשה מעשיו המכוערים בשני שליש החדש השלישי, אכן ייעשה בן סורר ומורה, כי מי אמר לך ללכת אחרי האפשרות "אם" היה מעבר אשה היולדת לשבעה,

נלך אחר הרוב, ורוב נשים יולדות לתשעה, ואין מתחשבים באפשרות שאינה כל כך רגילה, והיא רק במיעוט נשים.

האמוראים דנים בשאלה זו. אם בדיני נפשות הולכים אחר הרוב לחומרא, דהיינו, במקום שכתוצאה מהליכה אחר רוב יתחייב הנידון מיתה, ואם ילכו אחר המיעוט יפטר ממיתה, האם הולכים אחר הרוב, כשם שהולכים אחר הרוב בשאר דיני התורה, או לא מטעם "והצילו העדה".

שנינו משנה, שממנה יש להוכיח שאף בדיני נפשות הולכים אחר הרוב:

המשנה מדברת בחקירות עדים, עידי נפשות, שאם יסתרו זה את זה עדותם בטלה, ויזוכה הנידון -

שני העדים מעידים על אירוע שאירע [לדוגמא] ביום אחד בשבת, אלא כשחוקרים אותם על ימי החודש -

שנינו עוד משנה שממנה יש להוכיח שאף בדיני נפשות הולכים אחר הרוב.

המשנה מונה והולך דינים של קטנה מבת שלש שנים עד היותה גדולה. והכלל בכל דינים אלו הוא: פחותה מבת שלש שנים אינה בת ביאה כלל, אלא כנותן אצבע בעין, וכשהיא בת שלש שנים ביאתה ביאה, אלא שאינה בת עונשין.

בת שלש שנים ויום אחד

מתקדשת בביאה

. קטנה אין לה "יד" להתקדש, ומעשיה אינם נחשבים כלום. ואילו אביה יכול למסרה לקידושין לאיש אחר, בקידושי כסף ושטר וביאה. אם האיש מקדשה בכסף ושטר, הרי היא קנויה לו לגמרי, והיא אשת איש לכל דבריה, ואף בהיותה פחותה מבת שלוש שנים. אבל אם מסרה לאיש אחר לקידושי ביאה, אינה מתקדשת בהיותה פחותה מבת שלש שנים, שאין זו ביאה, אלא מעת היותה שלש שנים.

ואם בא עליה יבם

קנאה

. אם היתה נשואה לאיש בקידושי אביה, כנ"ל, ומת בעלה בלא בנים, הרי היא זקוקה להתייבם ככל יבמה.

ואם בא עליה יבם, שקידושי ביאה הן הם קידושי יבמה [מן התורה], קנאה, והיא אשתו לכל דיני התורה, ליורשה - את נכסיה את מתה, ולירש נכסי בעלה המת, ולהיטמא לה אם הוא כהן והיא מתה, ואינה זקוקה עוד ליבום - שלכן מגרשה בגט ולא בחליצה.

ואילו אם היא פחותה מבת שלוש שנים, אין ביאתה ביאה, והיא זקוקה ליבום או חליצה, ככל אשה "שומרת יבם".

וחייבין עליה משום אשת איש

. אם השיאוה אביה, כנ"ל. ובא עליה איש אחר, ביאתו בה היא ביאה, ויתחייב עליה כבכל אשת איש. [היא פטורה שהרי אינה בת עונשין]. ופחותה מבת שלוש, לא חייבין עליה.

ומטמא

[ומטמאה]

את בועלה לטמא משכב התחתון כעליון

. אשה נדה מטמאה משכבה [מצעות וכדומה] והם נעשים "אב הטומאה" לטמא אדם וכלים, היינו, שאם אדם וכלים נגעו במשכבה, נטמאו. דין זה הוא אף בתינוקת בת יום אחד.

הבועל את הנדה, נטמא, כמו שאמרה התורה: "ותהי נדתה עליו". אבל אינו חמור כמוה, ומשכבו נעשה רק "ראשון לטומאה", ואינו מטמא אדם וכלים כנדה אלא אוכלין ומשקין בלבד. [טומאה זו קראוה חז"ל: "תחתון כעליון", וכוונתם להדגיש שאין משכבו התחתון נעשה אב הטומאה כטומאת משכב הנדה בעצמה, אלא ראשון "כעליונו של זב"].

האמור, שהבועל את הנדה מטמא משכב תחתון כעליון, הוא רק בבת שלש שנים, שבעילתו בעילה היא, ואילו אם היא פחותה מבת שלוש שנים, אינו אלא כנוגע בנדה, ונהיה טמא טומאה קלה, שהיא טומאה עד הערב.

נישאת לכהן אוכלת בתרומה

. בת ישראל הנשואה לכהן אוכלת בתרומה. מן התורה אוכלת מאירוסיה, ואילו חכמים גזרו שלא תאכל עד כניסתה לחופה.

חופה זו תלויה בביאה, דהיינו אם ביאתה ביאה, חופתה מזכה אותה באכילת תרומה, ולכן, בת שלש שנים שאביה קיבל בה קידושין מאיש כהן, והכניסה לחופה, כיון שביאתה ביאה, חופתה מאכילתה בתרומה, ואילו פחותה מבת שלש שנים שאין ביאתה ביאה - אין חופתה חופה, ואינה אוכלת תרומה.

בא עליה אחד

. אשה שנבעלה לגוי, חלל, נתין וממזר אסורה להינשא לכהן, והיא פסולה לכהונה.

דין זה אמור רק בבת שלש שנים, שביאתה ביאה, ולא בפחותה מכך.

And Rabba concludes his exposition:

And the Merciful One said:

with regard to a minor, you do not need to go back over it,

And this is Rabba’s exposition, that “a minor does not beget.”

Abaye challenged him:

Abaye raises an objection to Rabba from a beraita taught concerning a designated maidservant.

It is stated in the Torah (Leviticus 19): “And if a man lies with a woman with an emission of seed, and she is a maidservant designated to a man… there shall be an inquiry.”

And the Sages expounded: “There shall be an inquiry”—she is liable for lashes.

The one who has intercourse is liable to bring a guilt-offering, as it is stated there: “And he shall bring his guilt-offering to the Lord” .

We learned in a beraita: If it had been stated in the Torah

“man,”

I would have only

that the maidservant is liable for lashes

but a man—

an adult of thirteen—

a son of nine years and one day, who is fit for intercourse, from where

that the woman is liable for lashes on account of his intercourse?

The verse teaches:

therefore the Torah wrote

“and”

“man,”

Thus the beraita held that a son of nine is fit for intercourse?

Rabba said to Abaye: There is no difficulty here, and the statements do not contradict one another, because

A man is mezid

and he emits seed, but a minor is not mezid and does not emit seed.

Rav Mordekhai said to Rav Ashi: From where is it inferred that this

“mezid”

is a term of cooking?

For it is written

(Genesis):

“And Jacob cooked a stew,”

he cooked a dish.

And we raise an objection from the words of Rabbi Ishmael, to prove that a minor does beget.

But Rabbi Ishmael taught:

It is stated in the Torah: “When a man has a “son,” and we expound:

a son and not a father. [This exposition of Rabbi Ishmael is not the statement of Rav Hisda. For Rav Hisda is speaking of a minor who begot: the “son” does not become a stubborn and rebellious son, whereas Rabbi Ishmael is speaking of a minor who begot: the “father” does not become a stubborn and rebellious son.]

And the one who raised the objection understood that Rabbi Ishmael’s intention was to expound that if he has already fathered a son, he does not become a stubborn and rebellious son.

What are the circumstances?

In what manner was Rabbi Ishmael speaking?

And consequently it is impossible to say this, that in such a manner the Torah exempted him, for without the birth of a son he is exempt because his beard has already encircled; why, then, was it necessary to exempt him because he had already fathered a son?

And learn from it: A minor begets!

The Gemara’s objection is based on the assumption that Rabbi Ishmael’s exposition, “a son and not a father,” and Rabbi Krospe dai’s statement, “all the days of a stubborn and rebellious son are only three months,” are two separate matters. Therefore they asked: How is it possible within three months to impregnate a woman and beget?

The Gemara answers that Rabbi Krospe dai’s statement is indeed the exposition of Rabbi Ishmael. That is, a minor does not beget, and the Torah did not come to exclude a son who has already fathered a child, since such a case does not exist in reality. The Mishna lists and proceeds through laws concerning a minor girl from when she is three years old until she becomes an adult. The general rule in all these laws is: One younger than three years old is not at all capable of intercourse, but rather it is like one placing a finger in an eye; and when she is three years old, intercourse with her is intercourse, except that she is not subject to punishments.

A minor has no “agency” with which to become betrothed, and her actions are considered nothing.
