Original text — Nedarim 68b

אבל, אם שמע

הארוס את הנדר

וקיים

אותו,

או ששמע ושתק, ומת ביום שלאחריו

, ונמצא שהחריש לה ביום שמעו, הרי זה נחשב כמוקיום

.

ולכן

אין האב יכול להפר

נדרים אלו

.

ב. אם

שמע אביה

את הנדר

והפר לה, ולא הספיק הבעל לשמוע

את הנדר

עד שמת האב, זו היא ששנינו

במשנה: אם

מת האב,

אפילו אחר שכבר הפר,

לא נתרוקנה רשות

האב

לבעל,

ואין הארוס יכול להפר לבד.

ג. אם

שמע בעלה והפר לה, ו

אפילו אם

לא הספיק האב לשמוע

את הנדר

עד שמת הבעל

Translation

But if the betrothed heard

the vow

and upheld it

it,

or he heard and remained silent, and died on the following day,

and it was found that he had remained silent to her on the day he heard it, this is considered as upheld.

And therefore

the father cannot annul

these vows.

b. If

her father heard

the vow

and annulled it for her, but the husband did not manage to hear

the vow

until the father died, this is what we learned

in the Mishna: If

the father died,

even after he had already annulled it,

the authority was not emptied

of the father

to the husband,

and the betrothed cannot annul it alone.

c. If

her husband heard and annulled it for her, and

even if

the father did not manage to hear

the vow

until the husband died,

the father can annul it. And

this too is

included in what

we learned: The husband died, the authority was emptied to the father.

d. Even if

her husband heard and annulled it for her,

but

the father did not manage to hear

the vow

until he died, the husband cannot

return and

annul

the father’s portion, because

the husband annuls only in partnership

with the father .
