[לשם מה כפל התנא את דינו]!?

שמא תאמר: לא דמי רישא לסיפא, שהרי ברישא הקדיש את השור בתחילה לעולה, ואחר כך לשלמים, ואילו בסיפא הקדישו תחילה לשלמים ואחר כך לעולה; זו הרי אינה סיבה שיהא התנא צריך לשנות גם את הסיפא, שמן הרישא נדע כן, כי:

השתא יש לומר מקדושה חמורה

דהיינו קדושת עולה שהיא קדשי קדשים

לקדושה קלה

דהיינו שלמים שהם קדשים קלים

הקדושה -

מקדושה קלה לקדושה חמורה צריכא למימר!?

אלא בהכרח שאחת מן הבבות של הברייתא עוסקת בקדושת דמים, והאחרת בקדושת הגוף, ומלמדנו התנא שבין קדושת דמים ובין קדושת הגוף שניהם פקעו בכדי.

לפרש את הברייתא:

רישא של הברייתא: "שור זה עולה כל שלשים יום ולאחר שלשים יום שלמים, כל שלשים יום עולה לאחר שלשים יום שלמים", עוסקת בקדושת דמים וכגון שפדאו לאחר שלשים, וקדושת שלמים שהחיל עליה, הרי היא חלה לאחר הפדיון, [וכפי שכבר נתבאר לעיל].

ואילו סיפא של הברייתא "לאחר שלשים יום עולה ומעכשיו שלמים, לאחר שלשים יום עולה ומעכשיו שלמים" אכן עוסקת בקדושת הגוף, ואולם אין כוונת הברייתא - כאשר חשבנו בתחילה - שאכן חלים הקדושות כפי שאמר, אלא:

אדרבה כוונת הברייתא להשמיענו שאין קדושת העולה חלה, כי היות ובתוך כדי דיבור אמר שתהא קדושה קדושת שלמים, שוב חלה קדושת השלמים באופן שהיא אינה פוקעת לאחר שלשים, ומונעת מקדושת העולה מלחול אחריה, וללמדנו: קדושת שלמים לא פקעה בכדי.

וכדי שלא נאמר: קדושת העולה שאינה חלה לאחר שלשים אין זה משום קדושת השלמים שקדמה לה ומשום ש"קדושה לא פקעה בכדי", אלא משום שאמירתו אינה מועילה כלל להחיל עליה קדושה לאחר שלשים, כי אמירה שאינה מועלת מיד, אף לאחר זמן אינה מועילה -

לכן מבארת לנו הברייתא, באומרה, שהאומר: לאחר שלשים יום עולה ומעכשיו שלמים, הרי הדין הוא ש"לאחר שלשים יום עולה ומעכשיו שלמים" - שאינו כן, וכל הטעם הוא מפני שקדושת השלמים מונעתה.

ומפני מה באמת קדושת העולה ראויה לחול לאחר שלשים, אם לא שהיה אומר "מעכשיו שלמים", ואין אומרים: כיון שלא חלה אמירתו להקדישה מיד לעולה, אף לאחר זמן לא תחול:

מפני שדין זה הוא כדין -

האומר לאשה: התקדשי לי לאחר שלשים יום דמקודשת, ואף על פי שנתעכלו

הרי למדנו: אף על פי שלא חלו הקדושין היום, הרי הם חלים לאחר זמן, ואף כאן אף על פי שלא חל ההקדש מיד בשעתו, הרי הוא חל לאחר זמן. מתמהת הגמרא: והרי

פשיטא

היא שאמירתו עכשיו ראויה היא להחיל לאחר זמן את קדושת העולה, וכשם שבקדושין חלים הקידושים לאחר שלשים, ומעצמי הייתי יודע כי אם אכן אינה חלה קדושת העולה, אין זה אלא משום שקדושת השלמים אינה פוקעת, ולא היה צריך התנא להשמיענו את כל זאת!?

ומשנינן:

לא צריכא

הברייתא להשמיענו שאין הטעם מפני שאין ראויה כלל קדושת העולה לאחר שלשים, אלא באופן

דהדר ביה

[חזר בו] מהקדשת השור לעולה לאחר שלשים, שהייתי אומר כיון שחזר בו, אף בלאו קדושת השלמים שקדמה לו אין קדושת העולה ראויה לחול - ולזה הוצרך התנא לומר שחזרתו אינה מועילה לו, ואילו לא היה אומר "מעכשיו שלמים" היתה חלה קדושת העולה, אם לא שקדושת השלמים היא זו שמונעתה מלחול כיון שאינה פוקעת בכדי.

שנינו במשנה בקדושין נח ב "האומר לאשה: הרי את מקודשת לי לאחר שלשים יום, ובא אחר וקידשה בתוך שלשים יום מקודשת לשני".

ובגמרא שם נט א, איתא:

לא בא אחר וקידשה [בתוך שלשים] וחזרה בה, מהו?

רבי יוחנן אמר: חוזרת, אתי דיבור ומבטל דיבור.

ריש לקיש אמר: אינה חוזרת לא אתי דיבור ומבטל דיבור.

ומקשינן:

הניחא

לפרש שהברייתא עוסקת באופן שחזר בו אלא שאין חזרתו מועלת לו -

למאן דאמר

[ריש לקיש]: "האומר לאשה התקדשי לי לאחר שלשים יום" הרי זו מקודשת ו

אינה חוזרת

ואם כן, הרי מעצמנו נדע שאי חלות הקדושה לאחר שלשים אינה אלא מפני שקדושת השלמים מונעתה מלחול!?

ומשנינן: לעולם כשחזר בו, וחזרתו אינו מועלת לו, כי

On the contrary, the intention of the beraita is to inform us that the sanctity of the elevation-offering does not take effect, because since within the time required for speech he said that it should have the sanctity of a peace-offering, the sanctity of the peace-offering takes effect in such a way that it does not expire after thirty days, and prevents the sanctity of the elevation-offering from taking effect afterward , [and it teaches us: the sanctity of a peace-offering does not expire without anything].

Rather: On the contrary, the intention of the beraita is to teach us that the sanctity of the olah does not take effect. And why, in truth, is the sanctity of the elevation-offering fit to take effect after thirty days if he had not said “from now a peace-offering,” and do we not say: since his statement did not take effect to consecrate it immediately as an elevation-offering, it will not take effect even after a time

that his statement now is fit to impose the sanctity of an elevation-offering after a time, and just as in betrothal the betrothal takes effect after thirty days, I would know on my own that if the sanctity of the elevation-offering does not in fact take effect, this is only because the sanctity of the peace-offering does not expire, and the tanna did not need to inform us all this!?

And we answer:

for the beraita to inform us that the reason is not that the sanctity of the elevation-offering is entirely unfit to take effect after thirty days, but rather in a case

We learned in the Mishna in Kiddushin 58b: “One who says to a woman: ‘Behold, you are consecrated to me after thirty days,’ and another came and consecrated her within thirty days—she is consecrated to the second.”

And in the Gemara there, 59a, it is stated:

If another did not come and consecrate her [within thirty days], and she retracted, what is the law?

Rabbi Yohanan said: She may retract; speech comes and nullifies speech.

Resh Lakish said: She may not retract; speech does not come and nullify speech.

And we ask:

this is satisfactory

to explain that the beraita deals with a case where he retracted, but his retraction is ineffective for him—

according to the one who says

[Resh Lakish]: “One who says to a woman, ‘Be consecrated to me after thirty days,’” she is consecrated and

may not retract

within the period to say, “I do not want to become consecrated,” and therefore here too he cannot retract.

For necessarily the beraita deals with a case where he did not retract, since if he retracted, the sanctity would indeed not take effect because of his retraction, and there would be no need for the sanctity of the peace-offering to prevent it from taking effect.

If so, we would know on our own that the reason the sanctity does not take effect after thirty days is only that the sanctity of the peace-offering prevents it from taking effect!?

And we answer: it is always when he retracted, and his retraction is not effective for him, because
