של המשנה, שהנר היה בתוך החנות,

בעל גמל חייב,

משום

דלא איבעי ליה לאפושי בטעינה

[שלא היה צריך להטעין על הגמל כל כך הרבה פשתן] עד שיכנס לתוך החנות, וכיון שפשע בכך, חייב על מעשה הגמל אפילו שהיה אנוס בעת עשית הנזק, כיון שהיה לו למנוע מראש את הגמל מלהזיק, על ידי שהיה מטעינו בפחות פשתן.

סיפא

שהחנווני הניח את הנר מבחוץ,

חנווני חייב,

משום

דלא איבעי ליה לאנוחי נרו מאבראי

[שלא היה לו להניח את הנר מבחוץ], וכיון שפשע בזה, חייב החנווני על מה שהזיקה האש על ידי הגמל שהלך שם ברשות וכדין.

והגדי סמוך לגדיש,

ונשרף עמו

עם הגדיש -

פטור"

כי היות וחייב מיתה על העבד, שנאמר "נקם ינקם" [שמות כא כ], לפיכך פטור מתשלומים על הגדי והגדיש. לפי שיש דין "קם ליה בדרבה מיניה" [פירוש: התקיים החיוב ממון בחיוב הגדול יותר שחל עליו, דהיינו חיוב מיתה].

[מה ששנינו ברישא: "היה גדי כפות" לאוו דווקא, אלא אפילו לא היה כפות אלא סמוך, מכל מקום חייב עליו, לפי שאין לו דעת לברוח. ומה שנקטה הסיפא "וגדי סמוך לו", אגב הרישא נקטה כך, שהואיל וברישא נקטה גדי כפות ועבד סמוך, לפיכך נקטה כאן עבד כפות וגדי סמוך, ולעולם אין הבדל בגדי בין כפות לשאינו כפות ].

הכי נמי דלא מיחייב

[האם נפטר מתשלום ממון] מחמת זה? והרי מפורש בתורה שחייב ממון, שנאמר "כסף שלושים שקלים יתן לאדוניו" [שמות כא לב].

אמר לך רבי שמעון בן לקיש: הכא במאי עסקינן

[במשנה מדובר] -

כשהצית בגופו של עבד,

ובאופן זה ממש הרגו בידים וחייב מיתה, ולכן פטור מתשלום ממון,

דקם ליה בדרבה מיניה.

ומקשינן:

אי הכי,

אם המשנה מדברת באופן שהצית את העבד בידים,

מאי למימרא

שאין זה נחשב מעשה השולח אלא מעשה החרש, והחרש פטור על מעשיו.

[ריש לקיש] הסובר כי על

אשו

שהזיק חייב

משום

שנחשב

ממונו,

מדוע פטור כשמסר את אשו לידי החרש, והרי

אילו מסר

את

שורו לחרש שוטה וקטן

והזיק השור כשהיה ברשותם,

הכי נמי דלא מיחייב?

הרי הוא חייב על כך שלא שמר את ממונו כהוגן, כמבואר לעיל [י א] שאם מסרו לחרש חייב, כך גם באשו יש לו להתחייב על כך שלא שמר את אשו שלא תזיק.

הא אתמר עלה,

אמר ריש לקיש משמיה דחזקיה: לא שנו

שפטור על אשו שמסר לחרש שוטה וקטן

אלא כשמסר לו גחלת וליבה

אותו החרש, שהגחלת אינה יכולה להזיק כל זמן שלא מלבים אותה. ואינו נחשב כמוסר חפץ המזיק לידי חרש שוטה וקטן.

שלא הדליק בעצמו את גדישו של חבירו, אלא בתוך שלו הדליק, והאש הלכה מעצמה, ואף על פי כן כתוב

"ישלם המבעיר את הבערה",

שהתורה קוראת לו "המבעיר את הבעירה" כאילו הוא הדליקו בעצמו,

שמע מינה

Translation

Therefore, in the

first clause of the Mishna, where the lamp was inside the shop,

Мишны, где светильник находился внутри лавки,

the owner of the camel is liable,

because of

he should not have increased the load [he should not have needed to load so much flax onto the camel that it would enter the shop; and since he was negligent in this, he is liable for the camel’s act even though he was compelled at the time the damage was done, since he should have prevented the camel from causing damage in advance by loading it with less flax]. And whereas in the

because of

he should not have placed his lamp outside [he should not have placed the lamp outside]; and since he was negligent in this, the shopkeeper is liable for what the fire damaged through the camel that passed there with permission and according to law.

[What we learned in the first clause, “there was a kid tied,” is not specifically so; rather, even if it was not tied but merely near, nevertheless he is liable for it, since it does not have the understanding to flee. And what the final clause stated, “and a kid was near it,” it stated incidentally to the first clause: since in the first clause it stated “a kid tied and a slave near,” it therefore stated here “a slave tied and a kid near”; but in the case of the kid there is never a difference between one tied and one that is not tied].
