ופליגא דרב נחמן, דאמר רב נחמן
: דווקא
ערב דבית דין,
שנעשה ערב בפני בית דין,
הוא דלא בעי קנין,
כיון שבאותה הנאה שהאמינוהו בית דין לסמוך עליו בחוב זה, גמר בליבו לשעבד עצמו בערבות .
הא בעלמא
בשאר הערבויות, שלא נעשות בבית דין, שאין גמירות דעת גדולה כל כך,
בעי קנין
צריך לעשות קנין כדי שישתעבד בערבות.
והלכתא: ערב
אם נתחייב להיות ערב על ההלואה
בשעת מתן מעות
ההלואה ללווה -
לא בעי קנין,
ואפילו אם כתב את ערבותו בתוך השטר אחרי חתימת העדים, הרי זו ערבות גמורה, וגובים מערב זה אפילו מנכסים משועבדים.
אבל אם נתחייב להיות ערב
אחר מתן מעות
ההלואה ללווה -
בעי קנין
להשתעבד בערבות, כיון שמעות ההלוואה ניתנו קודם לכן, משמע שלא על אמונתו של הערב הלווהו, ואינו משתעבד כלל בלא קנין, ואפילו אם היה חתום בתוך השטר. ואם היה חתום אחרי חתימת העדים צריך לעשות קנין על הערבות, ואז גובה מנכסים בני חורין .

דבההיא הנאה דמהימן ליה

Translation
And it conflicts with Rav Nahman, for Rav Nahman said:
Precisely
a court guarantor,
who became a guarantor before the rabbinical court,
is the one who does not require an act of acquisition,
since through that benefit that the rabbinical court trusted him to rely upon him for this debt, he resolved in his heart to subject himself to the guarantorship .
Here, in general,
with the other guarantorships, which are not made before the rabbinical court, where there is not such a great firmness of intent,
an act of acquisition is required—
he must perform an act of acquisition in order to bind himself to the guarantorship.
And the halakha is: A guarantor
if he undertook to be a guarantor for the loan

And if he was signed after the witnesses’ signatures, he must perform an act of acquisition concerning the guarantorship, and then they collect from unencumbered property .
