Original text — Bava Batra 158a

מתניתין:

נפל הבית עליו ועל אשתו,

ואין לה בנים ממנו [שבנים הם ראשונים לירושה], ואין ידוע מי מת קודם.

יורשי הבעל אומרים: אשה מתה ראשונה,

והבעל ירש את אשתו, ואחרי שגם הוא מת, עובר הרכוש ליורשיו, שהם אביו או אחיו.

יורשי האשה אומרים: בעל מת ראשון,

ונפקעה ממנו זכות ירושת אשתו,

ואחר כך מתה אשה,

ולכן קרוביה ממשפחת אביה רוצים לרשת אותה -

בית שמאי אומרים: יחלוקו

מספק.

ובית הלל אומרים נכסים,

שהם נכסי צאן ברזל, שהיו קנויים לבעל, וצריך להחזיר את שוויים לאשה כשמגרשה או כשמת,

ב"חזקתן",

ויבואר בגמרא בחזקת מי הם.

כתובה,

מנה או מאתים שהתחייב הבעל בנשואין -

בחזקת יורשי הבעל,

כיון שזה ממון שהבעל צריך לתת ועד היום הוה מוחזק בזה לכן משאירים בחזקתו.

נכסים הנכנסים והיוצאים עמה

נכסי מלוג הקנויים לאשה והבעל אוכל פירות,

בחזקת יורשי האב.

שהם היורשים של האשה, כיון שהם קנויים לה והביאה אותם מבית אביה לכן יורשיה מקבלים אותם.

Translation

Mishna:

The house collapsed upon him and upon his wife,

and she had no sons from him [for sons are first for inheritance], and it is not known who died first.

The husband’s heirs say: The wife died first,

and the husband inherited his wife, and after he too died, the property passes to his heirs, who are his father or his brothers.

And

the wife’s heirs say: The husband died first,

and his right to inherit his wife was nullified,

and afterward the wife died,

and therefore her relatives from her father’s family wish to inherit her —

Beit Shammai say: They divide it

because of the uncertainty.

And Beit Hillel say: Property,

namely nikhsei tzon barzel, which were owned by the husband, and whose value he must return to the wife when he divorces her or when he dies,

is in its presumptive status,

and it will be explained in the Gemara: in whose presumptive status it is.

The marriage contract,

the maneh or two hundred zuz that the husband undertook at the marriage —

is in the presumptive status of the husband’s heirs,

since this is money that the husband must give, and until today he was established as possessing it; therefore, they leave it in his presumptive status.

Property that enters and leaves with her —

nikhsei melog, which belong to the wife and whose produce the husband consumes,

is in the presumptive status of the father’s heirs.

For they are the wife’s heirs; since they belong to her and she brought them from her father’s house, therefore her heirs receive them.
