א.
פרט ל
בהמה אשר
נשחטה בלילה
, שאינו זמן שחיטה.
ב.
ושנשפך דמה
לארץ לפני שנזרק מדמה על המזבח.
ג.
ושיצא דמה
לפני זריקה
חוץ לקלעים
ונפסל ב"יוצא".
בשלשה פסולים אלו,
שאם
בכל זאת
עלתה
העולה הפסולה על המזבח,
תרד.
אבל כל שאר הפסולים, מלבד אלו, אם העלו את בשרם על המזבח לא ירדו, אלא יקטירו אותם על המזבח

רבי שמעון אומר
: הא דכתיב "היא העולה על מוקדה על המזבח כל הלילה", דרשינן להאי קרא הכי:
"עולה", אין לי אלא עולה כשרה
שעלתה על המזבח

מנין לרבות
עולה פסולה
שנשחטה בלילה,
ושנשפך דמה, ושיצא דמה חוץ לקלעים
לפני שנזרק,
ו
עולה
הלן
דמה כל הלילה, ונפסל בלינה, ועדיין לא נזרק עד הבוקר,
והיוצא,
שיצא בשרה חוץ לעזרה,
והטמא
, שנטמא הבשר,
והנותר,
בשר עולה או אימורים שלנו כל הלילה חוץ למזבח, ונפסלו בלינה,
ושנשחט
במחשבה על מנת להקטיר
חוץ לזמנו וחוץ למקומו,
ושקיבלו פסולין
את הדם בכלי או שהפסולין
וזרקו את דמן,
והניתנין
שמצוה לתת את דמם
למעלה
[כגון דם חטאת בהמה, הניתן על קרנות המזבח],
שנתנן
לדמם
למטה,
והניתנין למטה שנתנן למעלה,
והניתנים בחוץ,
שמצוה לתת אותם על מזבח הנחושת
שנתנן בפנים
על מזבח הזהב
,
והניתנין בפנים
על מזבח הזהב,
שנתנן בחוץ
על מזבח הנחושת,
והפסח והחטאת ששחטן שלא לשמן
, שפסולים הם,
מנין
לכל הפסולים האלו שאם עלו על המזבח שלא ירדו?
תלמוד לומר "זאת תורת העולה". ריבה
הכתוב באומרו את הכלל "תורת העולה", שתהא
תורת אחת לכל העולין,
לומר,
שאם עלו
אפילו בפסול, שוב
לא ירדו!
יכול שאני מרבה
שלא יורידו אפילו
את הרובע והנרבע,
והמוקצה
, בהמה שהוקצתה לעבודה זרה,
והנעבד,
בהמה שהשתחוו לה בתורת עבודה זרה,
ואתנן
זונה, מי שנתן שה לזונה תמורת מעשה הזנות, נפסל השה לקרבן,
והמחיר
כלב, מי שהחליף שה בכלב נפסל השה לקרבן,
והכלאים
, הנולד מעז שבא על כבשה,
והטריפה, ויוצא דופן!?
תלמוד לומר "זאת"
, למעט פסולים אלו, שאף אם עלו ירדו.
ומה ראית לרבות את אלו
מהריבוי "תרת העולה",
ולהוציא את אלו
מהמיעוט "זאת"? שהרי הכתוב ריבה ומיעט, ולא פירש מה לרבות ומה למעט.
Translation
A.
Except for
an animal that
was slaughtered at night,
which is not the time of slaughter.
B.
And one whose blood was spilled
onto the ground before some of its blood was sprinkled on the altar.
C.
And one whose blood went out
before the sprinkling
outside the curtains, and was disqualified through “going out.”
and was disqualified because it had gone out.
With these three disqualifications,
that if
nevertheless
it went up
the disqualified olah on the altar,
it must come down.
But all the other disqualifications, apart from these, if they brought their flesh up onto the altar, they do not come down; rather, they burn them on the altar 13 .
Rabbi Shimon says:
that which is written, “It is the olah upon its firewood on the altar all night,” we expound this verse as follows:
“An olah”—I have only [learned] a valid olah
that went up on the altar.
From where [do we learn] to include
a disqualified olah
that was slaughtered at night,
and one whose blood was spilled, and one whose blood went out outside the curtains
before it was sprinkled,
and
an olah
whose [blood] remained overnight
whose blood remained all night and was disqualified through remaining overnight, and still had not been sprinkled until morning,
and one that went out,
whose flesh went out beyond the courtyard,
and one that is impure,
whose flesh became impure,
and the leftover,
the flesh of an olah or the sacrificial portions that remained all night outside the altar and were disqualified through remaining overnight,
and one that was slaughtered
with the thought to burn [it]
beyond its time and beyond its place,
and [one whose blood] disqualified persons received
the blood in a vessel, or the disqualified persons
sprinkled their blood,
and those [whose blood] is given
for which it is a mitzva to give their blood
above [
such as the blood of an animal sin-offering, which is given on the corners of the altar],
that he gave
their blood
below,
and those [whose blood] is given below, [that] he gave above,
and those [whose blood] is given outside,
for which it is a mitzva to give them on the copper altar
that he gave them inside
on the golden altar,
and those [whose blood] is given inside
on the golden altar,
that he gave them outside
on the copper altar,
and the Passover-offering and the sin-offering that he slaughtered not for their sake,
which are disqualified,
from where [do we learn
that all these disqualified offerings, if they went up on the altar, do not come down?
The verse states, “This is the law of the olah. It included
the verse by stating the general principle, “the law of the olah,” that there should be
one law for all that go up,
to say,
that if they went up
even with a disqualification, then
they do not come down!
Perhaps I should include
that they should not bring down even
the animal that copulated and the animal that was copulated with,
and the designated [animal],
an animal that was designated for idolatry,
and the worshipped [animal],
an animal to which they bowed as an act of idolatry,
and the prostitute’s wage
of a prostitute—a person who gave a sheep to a prostitute in exchange for the act of prostitution; the sheep is disqualified as an offering,
and the exchange
of a dog—a person who exchanged a sheep for a dog; the sheep is disqualified as an offering,
and the crossbred animal,
born from a goat that mated with a ewe,
and the animal with a fatal condition, and the one born by cesarean section!?
The verse states, “This”,
to exclude these disqualified offerings, which even if they went up must come down.
And what have you seen to include these
from the inclusion “the law of the olah,”
and to exclude these
from the exclusion “this”? For the verse included and excluded, but did not explain what to include and what to exclude.
