Nedarim 84a — the Talmud in English

Rava raised an objection to Rav Naḥman: And for is a husband not included among people? And we learned: “I am withdrawn from the Jews”— if she prohibited marital relations to herself from all Jews…

Original text — Nedarim 84a

איתיביה רבא לרב נחמן

:

ו

כי

בעל לאו בכלל בריות הוא?

והתנן: נטולה אני מן היהודים

אם אסרה על עצמה תשמיש המיטה מכל היהודים,

יפר

הבעל את

חלקו, ותהא משמשתו, ותהא נטולה מן

שאר

היהודים.

כיון שההפרה של הבעל אינה חלה אלא על מה שאסרה עצמה עליו, אבל במה שאסרה עצמה מאחרים, אינו יכול להפר.

ואי אמרת, בעל לאו בכלל בריות הוא,

מדוע צריך הבעל להפר את חלקו? הלא חלקו לא נאסר כלל!

ומתרצינן: לעולם בעל, לאו בכלל בריות הוא. ו

שאני הכא, דמוכחא מלתא דעל היתרא קאסרה נפשה.

שבאופן זה, שאסרה את עצמה מתשמיש המיטה, מוכח שהתכוונה אף לבעלה. כיון שעל אחרים הרי היא אסורה בלאו הכי.

שנינו במשנה:

יכולה ליהנות בלקט שכחה ופאה

ולא קתני

במשנה

ובמעשר עני.

ומשמע, שהמודרת הנאה מהבריות, אינה יכולה ליהנות ממעשר עני

ומקשינן:

והתניא בברייתא: ובמעשר עני

שיכולה היא אף ליהנות ממעשר עני, ונמצא שיש סתירה בין דברי המשנה לדברי הברייתא.

ומתרצינן:

אמר רב יוסף: לא קשיא.

הא רבי אליעזר, הא רבנן.

דתנן: בי אליעזר אומר, אין אדם צריך לקרות שם

[להחיל חלות שם מעשר על עשירית מהפירות]

על מעשר עני, של דמאי.

[בשם "דמאי" נקראים פירות של עמי הארץ, שגזרו חכמים להפריש מהם מעשרות, על אף שרוב עמי הארצות מעשרים את פירותיהם, כיון שחשודים הם שאינם נזהרים להפריש מעשרות].

וסבר רבי אליעזר, שהיות ודמאי הוא רק גזירת חכמים מחמת חשש ספק טבל, וגם אם יפריש את המעשר עני הוא לא יהיה חייב ליתנו לעניים, היות שספק ממון לקולא, לכן, לדעתו, אין צורך אפילו לקרוא שם על מעשר עני כלל.

Translation

Rava raised an objection to Rav Naḥman:

And

for

is a husband not included among people?

And we learned: “I am withdrawn from the Jews”—

if she prohibited marital relations to herself from all Jews,

he shall annul

the husband

his portion, and she shall serve him, and she shall be withdrawn from

the rest of

the Jews.

Since the husband’s annulment takes effect only with regard to that which she prohibited to herself from him, but with regard to that which she prohibited to herself from others, he cannot annul.

And if you say, a husband is not included among people,

why does the husband need to annul his portion? Is his portion not prohibited at all

? And we answer: In truth, a husband is not included among people. And

here it is different, for it is evident that she prohibited herself with regard to what is permitted.

For in such a case, where she prohibited herself from marital relations, it is evident that she intended even her husband, since with regard to others she is prohibited in any event.

We learned in the Mishna:

She may benefit from gleanings, forgotten sheaves, and the corner of the field:

But it does not teach

in the Mishna

“and from the tithe of the poor.”

And it follows that one who is prohibited by a vow from benefiting from people cannot benefit from the tithe of the poor

.

And we raise an objection:

But it was taught in a baraita: “and from the tithe of the poor”—

she may also benefit from the tithe of the poor, and it is found that there is a contradiction between the words of the Mishna and the words of the baraita.

And we answer:

Rav Yosef said: It is not difficult.

This is Rabbi Eliezer; that is the Rabbis.

As we learned: Rabbi Eliezer says, a person need not designate

[to establish the status of a tithe upon one tenth of the produce]

the tithe of the poor of demai.

[The produce of common people is called “demai.” The Sages decreed that tithes be separated from it, even though most common people tithe their produce, since they are suspected of not being careful to separate tithes.]

And Rabbi Eliezer holds that since demai is only a decree of the Sages because of concern over the possible status of untithed produce, and even if he separates the tithe of the poor he is not obligated to give it to the poor, since in a case of monetary uncertainty the lenient ruling applies, therefore, according to him, there is no need even to designate the tithe of the poor at all.
