Original text — Nedarim 38b
ו
אילו
טמאה
נפשה וגופה לשמים,
שהרי היא אסורה באכילה.
אמרו לו: אף הטמאה, נפשה לשמים
-
וגופה שלו, שאם ירצה, הרי הוא מוכרה לעובדי כוכבים או מאכילה לכלבים,
ונמצא שהוא נהנה בפיטומה!
גמרא:
אמר רב יצחק בר חנניה אמר רב הונא: המודר הנאה מחבירו
-
מותר להשיא לו בתו.
הוי בה רבי זירא: במאי עסקינן?
אילימא בשנכסי אבי כלה אסורין על החתן,
אם כן, היאך מותר לו למדיר להשיא למודר את בתו,
הרי מוסר לו שפחה לשמשו
ומהנהו!
ו
אלא בנכסי חתן אסורין על אבי כלה,
וקא משמע לן שמותר להשיאה לו, אף שעל ידי כך מתחייב החתן לזונה, ונמצא שהוא מהנה את אביה,
הרי
גדולה מזו אמרו
במשנתינו:
זן את אשתו ואת בניו, ואף על פי שהוא חייב במזונותן, ואת אמרת: מותר להשיא לו בתו!?
הרי משנשאת שוב אין אביה חייב במזונותיה, ואם כן, הרי אינו פורע עבורו את חובו, ופשיטא שמותר!
ואמרינן:
לעולם, בשנכסי אבי כלה אסורים על החתן, ו
מדובר
בבתו בוגרת,
שמשיאה את עצמה, שכבר אין לאביה רשות בה.
ו
כיון שהיא משיאה עצמה
מדעתה
, לכן מותר.
תניא נמי הכי: המודר הנאה מחבירו

למדיר
להשיא לו
את
בתו.
אבל משיאו בתו בוגרת
-
ומדעתה.
אמר רבי יעקב: המדיר בנו,
שנדר שלא ייהנה מבנו,
ל
צורך
תלמוד תורה,
דהיינו, כדי שלא יתבטל בנו מלימודו ,
מותר
עדיין הבן
למלאות לו
לאביו
חבית של מים
[משל אביו],
ולהדליק לו את הנר.
והטעם, משום שמסתמא מדברים קטנים כאלו, שאינם מבטלין אותו מלימודו - לא הדירו .
רבי יצחק אמר
: מותר הבן אף
לצלות לו דג קטן.
אמר רבי ירמיה אמר רבי יוחנן: המודר
הנאה מחבירו, מותר להשקותו כוס של שלום.
ואף שמהנהו בכך, התירו מפני דרכי שלום , לפי שהיה דרכם בכך.
ודווקא כשהכוס של המודר - מותר. אבל אם היא של המדיר, הרי הוא מהנהו ממש - ואסור .
מאי ניהו
[מהו] כוס של שלום?
הכא תרגימו: כוס של בית האבל,
שדרך לשתות שם יין.
במערבא אמרי: כוס
מים חמים
של בית המרחץ.
שהרוחץ ולא שתה מים חמים, דומה כתנור שהסיקוהו מבחוץ ולא מבפנים [כדאיתא במסכת שבת מא א].
שנינו במשנתינו:
ולא יזון את בהמתו בין כו'.
תניא, יהושע איש עוזא אומר: זן
המדיר את
עבדיו ושפחותיו הכנענים
של המודר במזונות יתרים.
ולא יזון את בהמתו, בין טמאה
-
בין טהורה,
ואף במזונות יתרים, ודלא כרבי אליעזר של משנתינו.
מאי טעמא?
עבדיו ושפחותיו הכנענים
-
למנחרותא עבידן
. דהיינו, שאינם עומדים לאכילה, אלא לנחירה בעלמא . ולכן מותר לזונם מזונות יתירים, לפי שאינו נהנה בזה.
ואילו
בהמה
-
לפטומא עבידא,
והרי הוא נהנה בפיטומה, שיכול למכרה לגוי בדמים יתירים.
מתניתין:
המודר הנאה מחבירו, ונכנס לבקרו
בזמן מחלתו,
עומד, אבל לא יושב.
ומרפאו רפואת נפש, אבל לא רפואת ממון.
ובגמרא יתבאר מהי רפואת הנפש, ומהי רפואת ממון.

Translation
And
if
impure 
its life and its body belong to Heaven,
for it is forbidden to eat.
They said to him: Even the impure one, its life belongs to Heaven—
but its body belongs to him, for if he wishes, he may sell it to gentiles or feed it to dogs,
and it turns out that he benefits from its fattening!
Gemara:
Rav Yitzhak bar Hananya said in the name of Rav Huna: One who is mudar hanaa from his fellow—
it is permitted for the one who imposed the prohibition to marry his daughter to him.
Rabbi Zeira examined it: What are we dealing with?
If we say that the property of the bride’s father is forbidden to the groom,
then how is it permitted for the one who imposed the prohibition to marry his daughter to the one who is prohibited,
for he is handing him a maidservant to serve him—
and benefiting him!
And
rather, [we are dealing] with the property of the groom being forbidden to the bride’s father,
and it teaches us that it is permitted to marry her to him, even though through this the groom becomes obligated to provide her sustenance, and it turns out that he benefits her father,
behold,
they said something greater than this
in our Mishna:
He provides sustenance for his wife and his sons, even though he is obligated to provide their sustenance, and you say: It is permitted to marry his daughter to him!?
Behold, once she has married, her father is no longer obligated to provide her sustenance, and if so, he is not paying his debt on his behalf, and it is obvious that it is permitted!
And we say:
Actually, [we are dealing] with the property of the bride’s father being forbidden to the groom, and
we are speaking
of his adult daughter,
who marries herself, for her father no longer has authority over her.
And
since she marries herself
of her own accord ,
therefore it is permitted.
It was likewise taught in a beraita: One who is mudar hanaa from his fellow—
it is forbidden
for the one who imposed the prohibition
to marry his
daughter
to him.
But he may marry his adult daughter—
and [she does so] of her own accord.
Rabbi Yaakov said: One who imposed a prohibition on his son,
who vowed that he would not benefit from his son,
for
the sake of
Torah study,
that is, so that his son would not be distracted from his study ,
it is permitted
for the son still
to fill for him
for his father
a barrel of water
[from his father’s property],
and to light the lamp for him.
And the reason is that presumably, concerning such minor tasks, which do not distract him from his study, he did not impose the prohibition .
Rabbi Yitzhak said:
The son is also permitted
to roast a small fish for him.
Rabbi Yirmeya said in the name of Rabbi Yohanan: One who is mudar
from benefiting from his fellow, it is permitted to give him the cup of peace.
And although he benefits him through this, they permitted it because of the ways of peace , for this was their practice.
And specifically when the cup belongs to the one who is prohibited—it is permitted. But if it belongs to the one who imposed the prohibition, then he truly benefits him—and it is forbidden .
What is it
[that is meant by] the cup of peace?
Here, they interpreted: a cup in a mourner’s house,
for it is customary to drink wine there.
In the West they said: a cup of
hot water
from a bathhouse.
For one who bathes and does not drink hot water is like an oven that they heated from the outside but not from the inside [as it is stated in tractate Shabbat 41a].
We learned in our Mishna:
And he may not provide sustenance for his animal, and so forth.
It was taught in a beraita: Joshua איש Uza says: He provides sustenance for
the one who imposed the prohibition’s
Canaanite male and female slaves
of the one who is prohibited, with extra sustenance.
And he may not provide sustenance for his animal, whether impure—
or pure,
even with extra sustenance, and not like Rabbi Eliezer of our Mishna.
What is the reason?
His Canaanite male and female slaves—
they are made for slaughter .
That is, they are not intended for eating, but merely for slaughter . And therefore it is permitted to provide them with extra sustenance, since he does not benefit from this.
But
an animal—
it is made for fattening,
and he benefits from its fattening, for he can sell it to a gentile for a higher price.
Mishna:
One who is mudar hanaa from his fellow and enters to visit him
during his illness,
stands, but does not sit.
And he heals him with healing of the soul, but not with healing of property.
And in the Gemara it will be explained what healing of the soul is and what healing of property is.
