Original text — Ketubot 92b

אבל שבק בינונית דכוותה

, אם השאיר לוי ביד שמעון קרקע בינונית כמו זו שלו, אין יכול המלוה לגבות את חובו מלוי, ומשום ד

מצי אמר ליה

לוי למלוה:

"הנחתי לך

בשעה שקניתי את השדה -

מקום לגבות הימנו

" [משמעון] את חובך.

וכך טוען לוי: היות והיה ביד שמעון קרקע בינונית בשעה שקניתי, ואילו בא בעל החוב כשהיו עדיין שתי הקרקעות הבינוניות ביד שמעון, הרי לא היה בעל החוב יכול לאלץ את שמעון לקחת דוקא את השדה הבינונית שנמסרה לי אחר כך, אלא יכול היה שמעון לתת לו איזה קרקע בינונית שירצה, ולכן טוען אני "מה מכר ראשון [שמעון] לשני [לי, ללוי] כל זכות שתבוא לידו", וכשם שבשעתו היתה לו זכות לדחות אותך לבינונית זו שעכשיו היא בידו, אף עכשיו כך הוא הדין שתידחה אצל הבינונית שביד שמעון.

כלומר: יכול ראובן לעמוד בדין עם בעל החוב ולטעון טענות כדי שיסתלק בעל החוב משמעון, וכגון שיאמר ראובן לבעל החוב: כך וכך יש לי תביעה נגדית עליך, ואיני משלם את החוב הזה, כי מעכב אני מלפורעו תחת החוב הנגדי, או שיאמר לבעל החוב [כדרך שהיה יכול לומר לו אילו בא ליפרע ממנו] "אישתבע לי דלא פרעתיך", וכל כיוצא בזה.

משום דאמר ליה

ראובן לבעל החוב: "מאי

דמפקת מיניה עלי הדר

" [מה שאתה מוציא משמעון יחזור עלי], שהרי באחריות מכרתי לו.

ואיכא דאמרי

אפילו שלא באחריות נמי

, גם אם מכרה ראובן לשמעון שלא באחריות, יכול הוא לעמוד בדין עם מי שבא לטרוף את הקרקע, ואף על פי שאינו יכול לטעון: "דמפקת מיניה עלי הדר".

", אינך כעת בעל דברים שלי, שהרי משמעון אני בא לגבות ולא ממך.

ראובן לבעל החוב:

"לא ניחא לי דתהוי ליה לשמעון תרעומת עלי

" [אין רצוני שיהיה לשמעון - שקנה ממני שדה משועבדת וטרפוה ממנו - תרעומת עלי על כך].

ראובן שמכר שדה לשמעון שלא באחריות

שאפילו אם יתברר שהשדה גזולה היא בידו, לא יפצהו - ועדיין לא נתן הלוקח את מעות השדה.

Translation

But he left intermediate property of the same kind:

if Levi left in Shimon’s possession intermediate property like his own, the creditor cannot collect his debt from Levi, because

he can say to him

Levi can say to the creditor:

“I left you—

when I purchased the field—

a place from which to collect”

your debt [from Shimon].

And this is how Levi argues: Since Shimon had intermediate property in his possession at the time I purchased, whereas if the creditor had come when the two intermediate properties were still in Shimon’s possession, the creditor could not have compelled Shimon to take specifically the intermediate field that was subsequently transferred to me, but Shimon could have given him whichever intermediate property he wished, therefore I argue, “What the first [Shimon] sold to the second [to me, to Levi] was every right that would come into his possession,” and just as at that time he had the right to direct you to this intermediate property that is now in his possession, so now as well the law is that you should be directed to the intermediate property in Shimon’s possession.

Abaye said: Reuven sold a field to Shimon with a guarantee, and Reuven’s creditor came and seized it from him

that is, if Reuven’s creditor came in order to seize the field from Shimon, since it had become encumbered to him while it was in Reuven’s possession—

it is the law that Reuven goes

the seller

and indemnifies him

the creditor.

That is, Reuven can stand in judgment with the creditor and present claims so that the creditor will withdraw from Shimon; for example, Reuven may say to the creditor: I have such-and-such a counterclaim against you, and I am not paying this debt, because I am withholding payment of it on account of the counterclaim, or he may say to the creditor [as he could have said to him had he come to collect from him], “Swear to me that I have not paid you,” and anything similar.

Because he says to him

Reuven says to the creditor: “What

you take from him returns upon me” [what you take from Shimon will come back upon me],

for I sold it to him with a guarantee.

And some say:

Even without a guarantee as well,

even if Reuven sold it to Shimon without a guarantee, he can stand in judgment with the one who comes to seize the property, although he cannot claim: “What you take from him returns upon me.”

And he cannot say to him

the creditor cannot say to Reuven:

“You are not

a litigant of mine,”

you are not presently my litigant, since I am coming to collect from Shimon and not from you.

And because

he says to him

Reuven says to the creditor:

“I do not want Shimon to have a grievance against me”

[I do not want Shimon—who purchased from me a field that was encumbered and had it seized from him—to have a grievance against me over this].

Reuven sold a field to Shimon without a guarantee—

so that even if it becomes clear that the field was stolen property in his possession, he will not compensate him—and the purchaser has not yet given the money for the field.
