זה

בית חייהם.

כלומר, תלמוד תורה.

"את הדרך"

-

זו גמילות חסדים

. "ילכו"

-

זו ביקור חולים. "בה"

-

זו קבורה. "את המעשה"

-

זה הדין. "אשר יעשון"

זו לפנים משורת הדין.

הגמרא מביאה מקרה נוסף בדין שולחני:

ריש לקיש אחוי ליה דינרא לרבי אלעזר,

על מנת לבודקו.

אמר

-

מעליא הוא.

אמר ליה

ריש לקיש:

חזי דעלך קא סמכינא

[תן ליבך לבדוק היטיב, כיון שאני סומך על דיברתך]!

אמר לו

רבי אלעזר -

כי סמכת עלי מאי למימרא

[מה בכך שסמכת עלי]

? דאי משתכח בישא בעינא לאיחלופי לך

[וכי אם ימצא הדינר רע, האם תוכל לתובעני]?!

והא את הוא דאמרת

"רבי מאיר הוא דדאין דינא דגרמי", מאי לאו

[האם לא התכוונת לומר] שרק

ר' מאיר

סובר כך,

ולא סבירא לן כוותיה?!

אמר לו

ריש לקיש -

לא! ר' מאיר וסבירא לן כוותיה.

דנה הגמרא:

הי רבי מאיר

[היכן מצינו שרבי מאיר דן דינא דגרמי] ?

אילימא רבי מאיר

(ד' ל' מ' פ' סימן

) דתנן

במסכת סנהדרין (ו' ע"א) -

"דן את הדין, זיכה את החייב, חייב את הזכאי, טימא את הטהור,

טיהר את הטמא,

מה שעשה עשוי, וישלם מביתו".

ומשמע שחייב לשלם מדינא דגרמי,

משם אין ראיה. ד

הא איתמר עלה אמר רבי אילעא אמר רב

-

והוא שנטל ונתן ביד.

ואז אינו גרמא, אלא מזיק בידים.

אלא הא ר' מאיר, דתנן

(לקמן ק:) -

"

הנותן צמר לצבע ...

לצבוע לו אדום וצבעו שחור, שחור וצבעו אדום, ר' מאיר אומר

-

נותן

לו דמי צמרו".

ומשמע - מדינא דגרמי.

גם משם אין ראיה - ד

התם קא עביד

מעשה

בידים,

ואין כאן גרמא.

אלא הא ר' מאיר דתנן

במסכת כלאים פרק ז' משנה ד') -

"המסכך גפנו על גבי תבואתו של חבירו, הרי זה קידש

[כלומר, אסר את התבואה מדין כלאיים]

וחייב",

ומשמע - מדינא דגרמי.

אלא הא רבי מאיר דתניא

the house of their life.

That is, Torah study.

“The way” —

this is acts of kindness

. “They shall walk” —

this is visiting the sick. “In it” —

this is burial. “The deed” —

this is the law. “Which they shall do” —

this is [acting] beyond the letter of the law.

The Gemara brings another case concerning the money-changer:

Reish Lakish showed a dinar to Rabbi Elazar,

in order to examine it.

He said —

It is good.

He said to him

Reish Lakish:

See that I am relying upon you

Give your attention to examining it well, since I am relying on your word]!

Rabbi Elazar said to him —

Rabbi Elazar:

What is there to say because you relied upon me

What difference does it make that you relied upon me]

? For if it is found to be bad, can I be required to replace it for you

and if the dinar is found to be bad, can you sue me]]?!

But you are the one who said —

“It is Rabbi Meir who rules the law of dina de-garmei”; is it not so

did you not intend to say] that only

Rabbi Meir

holds this way,

but we do not hold in accordance with him?!

Reish Lakish said to him —

Rish Lakish:

No! It is Rabbi Meir, and we hold in accordance with him.

The Gemara discusses:

Which Rabbi Meir

where do we find that Rabbi Meir rules the law of dina de-garmei] ?

If you say Rabbi Meir

(the mnemonic: D, L, M, P

) as it was taught

in tractate Sanhedrin (6a) —

“If he judged the judgment, acquitted the liable, declared the entitled liable, declared the pure impure,

declared the impure pure,

what he did is done, and he shall pay from his own property.”

And it implies that he is liable to pay by the law of dina de-garmei,

From there there is no proof. For

it was stated concerning it: Rabbi Ila said in the name of Rav —

and this is when he took it and gave it with his hand.

And then it is not gerama, but one who causes damage directly by hand.

Rather, it is this Rabbi Meir, as it was taught (

below, 100b) — “

the one who gives wool to a dyer …

to dye it red for him, and he dyed it black; black, and he dyed it red, Rabbi Meir says —

he gives

him the value of his wool.”

And it implies — by the law of dina de-garmei.

From there too there is no proof — for

there he performs

an act

with his hands,

and there is no gerama here.

Rather, it is this Rabbi Meir, as it was taught

in tractate Kilayim, chapter 7, Mishna 5 —

“One who trains his vine over the produce of his fellow, behold, this has consecrated

that is, he forbade the produce under the law of mixed species]

and is liable,”

and it implies — by the law of dina de-garmei.

From there too there is no proof, for

there too he performs

an act

with his hands.

Rather, it is this Rabbi Meir, as it was taught

in a beraita of Kilayim —

“The partition of the vineyard that was breached,
