Translation
Rather, what can you say? That they rise
from one matter to another, [
they pass from one matter to another] so that he cannot retract.
If so,
here too
it is possible to reconcile the words of Rabba,
that
he is speaking of a case in which
they rose, and afterward sat down.
And then he cannot retract.
And the halakha is in accordance with him, with Rav Yosef,
in the three cases below: a.
With regard to a field [
the dispute mentioned above (12b), concerning brothers who divided their father’s landed property, and one of them wants a particular field adjacent to his field. And Rav Yosef’s view is that he cannot specifically claim this field],
b
. Matter [
that is, the issue before us: “as long as they are occupied with that matter”],
c.
And half [
below (143a), concerning one who said to his wife, “My property is yours and your son’s”; Rav Yosef said that she acquired half of the property] .
We learned in the Mishna:
“The woman [inherits] her son
and the woman [inherits] her husband, and the mother’s brothers transmit an inheritance but do not inherit.”
And so on:
And the Gemara discusses:
Why do I need this also?
It already taught it at the beginning: “The man [inherits] his mother, and the man [inherits] his wife,
inherit but do not transmit an inheritance,” and from this we necessarily understand the opposite: that the woman does not inherit her husband and her son? And the Gemara answers:
This teaches us that “the woman [inherits] her son” is analogous to “the woman [inherits] her husband”: Just as with regard to “the woman [inherits] her husband,” the husband does not inherit his wife in the grave,
that is, she does not transmit to him property that is due to come to her after her death, [and he does not inherit it in the grave in order to transmit it to her husband], but he inherits only property that was in her possession at the time of death .
Likewise, with regard to the woman [inheriting] her son, the son does not inherit his mother in the grave,
for example, if he dies and afterward his mother dies, he does not inherit his mother’s property in order
to transmit
it
to the brothers
of his
from the father,
but her relatives on her father’s side inherit her. After we learned in the Mishna that the woman does not inherit her son, various opinions concerning this law are brought below:
Rabbi Yohanan said in the name of Rabbi Yehuda ben Rabbi Shimon
By Torah law [
it can be learned from the verse], that
the father inherits his son,
and his daughter, as we expounded above (109a and there).
And
likewise,
a woman inherits her son.
Where his father is not present .
As it is stated, “
And every daughter who inherits an inheritance from
the tribes
of the Children of Israel,”
and we established it above (111a) as referring to a daughter who inherits from two tribes—that is, her father’s tribe and her mother’s tribe
? And we expound:
The mother’s tribe is compared to the father’s tribe: Just as with the father’s tribe, the father inherits his son, so too with the mother’s tribe, the woman inherits her son.
