Avodah Zarah 62a — the Talmud in English

It was already explained above (54b) that idolatry seizes its money. That is, not only is it itself forbidden for benefit, but even if one sold it and received money for it, the money is forbidden…

Original text — Avodah Zarah 62a

כבר התבאר לעיל (נד' ב'), שעבודה זרה תופסת דמיה. כלומר, לא זו בלבד שהיא עצמה אסורה בהנאה, אלא אף אם מכרה, וקיבל עבורה כסף, הכסף נאסר בהנאה. למדנו זאת, מהאמור בתורה בענין עבודה זרה (דברים ז' כו')

"והיית חרם כמהו",

ודרשינן, "כל שאתה מהיה ממנו, הרי הוא כמוהו".

דין זה שייך גם ביין נסך, כיון שהתנסך לעבודת כוכבים, דינו כעבודת כוכבים, ואוסר את דמיו.

במשנתינו יבואר, שהחמירו חכמים חומרא נוספת ביין נסך, שלא זו בלבד שתופס את דמיו, אלא אף השכר שמשתכרים מעבודה ביין נסך, אסור בהנאה.

כלומר, מדוע גזרו חכמים לאסור שכר יין נסך יותר משאר איסורי הנאה?

כיון שאמר "לקוט לי בו", הרי זה לשון מכר, וכאילו אמר לו "מכור לי ירק בשוי האיסר". ולכן הדינר נתפס בקדושת שביעית, ואין להשתמש בו אלא לצרכי אכילה ושתיה וסיכה כדין השימוש בפירות שביעית, וכן אסור להשהותו אחר זמן הביעור .

ברם, אם אמר, הילך דינר זה ו

לקוט לי ירק היום,

כיון שנותן לו את הדינר כשכר העבודה בלבד,

שכרו מותר".

הרי מבואר, שאף על פי שהשביעית תופסת את דמיה, מכל מקום שכרה מותר אף מדרבנן, ולא גזרו בו שום איסור.

וקשה, אם כן מדוע בשכר יין נסך גזרו איסור?

אמר רבי אבהו אמר רב יוחנן

: ודאי משום גזירה אין לנו לגזור ולאסור שכרו משום דמיו. אלא

קנס הוא שקנסו חכמים בחמרין,

כמבואר להלן,

וביין נסך.

ודוקא בשני האופנים הללו החמירו, לפי שתופסים את דמיהם, לכן ראו לקנוס בשכר שהוא קצת כעין דמים. אבל בשאר איסורי הנאה, שאין תופסים את דמיהם, מסתבר שלא קנסו.

מבארת הגמרא מהו אותו קנס:

יין נסך, הא דאמרן,

שקנסוהו לאסור את שכרו.

"חמרין" מאי היא?

איזה קנס קנסו את החמרין [מובילי תבואה על גבי חמור]?

הגמרא מביאה ברייתא, העוסקת בענין "חמרין", ומתוך דברי האמוראים שדנו בבאור הברייתא, יתבאר לנו מהו הקנס שקנסו בחמרין.

Translation

It was already explained above (54b) that idolatry seizes its money. That is, not only is it itself forbidden for benefit, but even if one sold it and received money for it, the money is forbidden for benefit. We learned this from what is stated in the Torah concerning idolatry (Deuteronomy 7:26

“And you shall be accursed like it,”

and we expound: “Everything by which you enrich yourself from it is like it.”

This law also applies to yayin nesekh, since it was poured as an offering to idolatry: its law is like that of idolatry, and it renders its money forbidden.

In our Mishna it will be explained that the Sages imposed an additional stringency concerning yayin nesekh: not only does it seize its money, but even the wages earned from working with yayin nesekh are forbidden for benefit.

Поэтому полученные им деньги являются деньгами за вино, возлитое в идолопоклоннических целях, и запрещены. ( Рашба в «То́рат ха-Ба́йт», а в качестве закона его привели Тур и Шулхан арух Йоре-Деа 133) состоит в том, что даже если работник сделал это бесплатно, получив лишь обещанную выгоду, его имущество изымают на сумму, равную его плате. Их источник — Иерусалимский Талмуд. Однако Рамбам Ор Самеах разъясняет: по мнению Рамбама, Вавилонский Талмуд в нашей теме расходится с Иерусалимским и считает, что сущность наказания такова: как вино, возлитое в идолопоклоннических целях, запрещает деньги, полученные за него, так оно запрещает и плату за работу с ним. Из этого видно, что плата запрещена всем; ведь если бы это было не так, почему он сжёг зерно, полученное за вино, а не отдал его бедным? В примечаниях Хешек Шломо (ниже, лист 62б) ответил: там речь идёт о большой плате, а если плата велика, то даже по мнению «Орхот хаим» её запретили полностью для всех. Третий подход мы находим у Бах (Йоре-Деа, начало параграфа 133), который понимает мнение Тура так: сущность наказания за плату за работу с вином, возлитым в идолопоклоннических целях, точно такая же, как при продаже этого вина. Как при продаже такого вина: если нееврей сначала отдал продавцу деньги, а затем взял вино, деньги запрещены для получения пользы всем; но если он сначала взял вино, а затем отдал деньги, они запрещены только продавцу, а другим разрешены — таков же закон и в отношении платы за работу с таким вином. Если нееврей сначала отдал плату, а затем работник выполнил работу, плата запрещена самому работнику, но разрешена другому еврею; если же работник сначала выполнил работу, а затем получил плату, она запрещена всем. Однако законоведы оспорили его мнение (см. Шах там, в первом примечании) и считали, что не следует различать случай, когда плата была выдана до работы, и случай, когда работа была выполнена до получения платы: в любом случае плата запрещена всем. Некоторые объясняли, что, возможно, именно эта бочка стала причиной всей платы: если бы работник отказался её переносить, его вообще не наняли бы. ( Рашба и Ра״н). And likewise, a gentile

that is, what the Jew received for the donkey,

is forbidden

to sit upon it, even though the idolater placed his jug

of yayin nesekh

Gemara:

As stated in our Mishna, the Sages decreed that wages for work with yayin nesekh are forbidden for benefit.

And the Gemara asks:

What is the reason that his wages are forbidden?

That is, why did the Sages decree to forbid wages for yayin nesekh more than the other prohibitions from which benefit is forbidden?

If you say,

therefore they decreed concerning

its wages also,

be forbidden,

so that people would not come to permit the wine itself,

It cannot be said so, for

behold, orla and the mixed species of the vineyard, which are forbidden for benefit, and

nevertheless

we learned

(Kiddushin 56b) that if he

sold them and betrothed

a woman

with their money

she is betrothed.

And they did not decree a prohibition even upon the money of something from which benefit is forbidden, on account of the prohibition of the object itself. And all the more so, there is no reason to decree a prohibition upon the wages on account of the prohibition of the object itself.

Rather, since

yayin nesekh

seizes [

forbids]

its money

by Torah law

like idolatry,

therefore they decreed concerning its wages, so that people would not come to permit its money.

But concerning other prohibitions from which benefit is forbidden, where there is no prohibition upon the money, only upon the object itself, there is no concern that if we permit its wages people will come to permit the object itself.

And

there is still a difficulty:

behold, the Sabbatical produce, which seizes its money,

as is explained in the Gemara above (54b), from what is written, “For it is a Jubilee; it shall be holy to you,” we expound: “Just as the holy thing seizes its money and is forbidden, so too Sabbatical produce seizes its money and is forbidden.”

And

nevertheless

we learned

(Sheviit, chapter 8, Mishna 4):

“One who says to a worker, ‘Here is this dinar,’

and

gather for me

with it

[that is, with its value]

vegetables

of Sabbatical produce

today, his wages are forbidden.

Since he said, “Gather for me with it,” this is the language of a sale, as though he had said to him, “Sell me vegetables worth the issar.” Therefore the dinar is seized by the sanctity of the Sabbatical year, and one may use it only for purposes of eating, drinking, and anointing, according to the law governing the use of Sabbatical produce; and it is likewise forbidden to keep it after the time of removal .

However, if he said, “Here is this dinar and

gather vegetables for me today,”

since he gives him the dinar only as wages for the work,

“his wages are permitted.”

It is thus explained that although the Sabbatical year seizes its money, nevertheless its wages are permitted even by rabbinic law, and they did not decree any prohibition concerning them.

And it is difficult, if so: why did they decree a prohibition concerning the wages of libation wine?

Rabbi Abahu said in the name of Rabbi Yohanan:

Certainly, because of a decree, we have no reason to decree and prohibit his wages because of their monetary value. Rather,

it is a penalty that the Sages imposed upon the donkey-drivers,

as explained below,

and upon libation wine.

Specifically in these two cases they were stringent, since their monetary value is operative; therefore, they saw fit to impose a penalty concerning wages, which are somewhat similar to monetary value. But with the rest of the forbidden items from which benefit is prohibited, whose monetary value is not operative, it is logical that they did not impose a penalty.

The Gemara explains what that penalty is:

“Libation wine”—that which we said,

that they penalized him by prohibiting his wages.

But

“the donkey-drivers”—what is it?

What penalty did they impose upon the donkey-drivers [those who carry produce on a donkey]?

The Gemara brings a beraita dealing with the matter of “donkey-drivers,” and through the words of the amoraim who discussed the explanation of the beraita, it will become clear to us what penalty they imposed upon the donkey-drivers.

For it was taught

in a beraita:

, “The donkey-drivers who were performing work with produce of the seventh year—their wages are of the seventh year.”

The amoraim were in doubt:

What is “their wages are of the seventh year”?

If you say that we give them wages from produce of the seventh year,

that is, if we say that the beraita is dealing with a case in which they performed permitted work with produce of the seventh year, and the tannai came to teach us that it is permitted to pay them their wages with produce of the seventh year,

this cannot be said, for if so,

it turns out that this one,

the employer,

pays

his

debt

to the donkey-drivers

from produce of the seventh year, and the Torah said (Leviticus 25:6): “

“The Sabbath of the land shall be yours

for eating,

and

from here the Sages derived that produce of the seventh year was permitted only for the benefit of eating,

and not for commerce.”

And payment of a debt is not the benefit of eating.

Rather

say,

that the beraita is dealing with a case in which they performed prohibited work with produce of the seventh year, such as bringing an excessive amount of produce at one time,

and the tannai came to teach us

that their wages acquire the sanctity of the seventh year.

Even if you explain it in this way, it is difficult:

And what becomes sacred?!

Do the wages really become subject to the sanctity of the seventh year?!

And

indeed

we learned (Tractate Sheviit, chapter 8, Mishna 4):

, “One who says to a worker: Here is this dinar and gather vegetables for me today,

his wages are permitted.

But if he said,

“Gather vegetables for me with it today, his wages are forbidden”

as above.

And it is proven that they did not impose a penalty upon one who performed prohibited work with produce of the seventh year, and they did not prohibit his wages.

Abaye said: In any event,

the beraita is dealing with a case in which they performed permitted work with produce of the seventh year, and the tannai came to teach us that

we give him

[it is permitted to pay them]

wages from produce of the seventh year.

And what is difficult for you

is how he can pay them from produce of the seventh year, for it is stated concerning the seventh year:

“For eating” and not for commerce,

as above?

It may be said:

That he gives it to him in a permitted manner.

He pays them the wages in a permitted manner—that is, he gives it to them as a free gift.
