Original text — Zevachim 71a

ומביאה המשנה כמה אופנים שבהם נאסר השור להקרבה משום שנעבדה בו עבירה, כגון -

א.

או

שהמית

השור

את האדם על פי עד אחד,

שלא באו שני עדים להעיד על כך בבית דין אלא בא עד אחד בלבד, ולכן לא נפסק על השור דין מיתה [כדין שור ההורג אדם], אך יחד עם זאת, הוא נפסל להקרבה בגלל העדות של העד האחד [לפי שנאמר "מן הצאן", להוציא את הנוגח].

או

שהמית השור אדם, ולא היו על כך עדים כלל, אלא שהוא נפסל להקרבה

Translation

And the Mishna brings several forms in which the ox is forbidden for sacrifice because a transgression was committed in it, such as—

the person on the testimony of one witness,

for two witnesses did not come to testify about this in the court, but only one witness came; therefore, a judgment of death was not issued concerning the ox [as the law of an ox that kills a person], but nevertheless it is disqualified for sacrifice because of the testimony of the one witness [since it is stated, “from the flock,” to exclude the goring animal].

Or

that the ox killed a person, and there were no witnesses concerning this at all, but it is disqualified for sacrifice

on the basis of

the admission of

the owner,

who admitted before the court that their ox killed a person. And the court does not sentence the ox to death on the basis of the owner’s admission; rather, its law is like the law of one who admits liability for a fine, who is exempt from death, but it is disqualified for sacrifice to the altar.

3. Or one witness testified or the owner admitted that the ox was disqualified for sacrifice

for

disqualification of

one that mated unnaturally,

that the ox mated unnaturally with a person, or

for

disqualification of

one with which unnatural intercourse was performed,

that a person performed unnatural intercourse with the ox. And the ox is not forbidden in eating, because its law is not death, since there were not two witnesses that it mated unnaturally or that unnatural intercourse was performed with it, and all its disqualification is only for sacrifice.

4. Or one witness testified or the owner admitted

for

disqualification of

an animal designated,

that that ox was designated for idolatry, and for disqualification of

one that was worshipped,

that they made it an object of idolatry and worshipped it.

5. Or with the disqualification of

the payment to a prostitute

of a prostitute,

and with the disqualification of “

the price

of a dog.”
