ויש לשאול: מדוע הוזכר בפסוק: "השופט אשר יהיה בימים ההם"?

וכי תעלה על דעתך שאדם הולך אצל הדיין שלא היה בימיו?

[קהלת ז]:

"אל תאמר: מה היה, שהימים הראשונים היו טובים מאלה!

שלא תאמר: לפי שהדורות הראשונים היו טובים וצדיקים מהדורות האחרונים, לפיכך היו הימים הראשונים טובים מאלה!

מכאן, שאי אפשר שיהיו הדורות האחרונים גדולים כראשונים.

ומדוע הוצרכו להוסיף שני דיינים אל היחיד?

גמרא:

שנינו במשנה: ראוהו בית דין וכל ישראל, ולא הספיקו לומר מקודש עד שחשיכה, הרי זה מעובר.

ומקשינן:

למה לי למיתנא "ראוהו בית דין וכל ישראל"?

מדוע המשנה הוסיפה שראוהו כל ישראל? הרי כבר ראוהו בית דין, ויכלו לקדש את החדש אף בלא ראיית כל ישראל!

ומתרצינן:

התנא הוצרך להוסיף זאת, משום ד

סלקא דעתך אמינא

[היה עולה בדעתך לומר] שכאשר ראוהו אף כל ישראל משתנה הדין.

הואיל וראוהו בית דין וכל ישראל

התפרסם שהירח נראה ביום שלשים, וראוי שיתקדש החודש מכח הפרסום הזה, ולא יעברוהו.

, השמיענו התנא, כי מאחר ולא אמרו בית דין "מקודש" אין הוא מתקדש, אלא מעברים את החדש.

שנינו בהמשך המשנה: [ראוהו בית דין וכל ישראל] נחקרו העדים.

והגמרא הניחה שהכל ענין אחד הוא. וכוונת המשנה לומר שראוהו כל ישראל, ואף העידו עדים לפני בית דין, ונחקרה עדותן.

\- עדות זו תהא מסורה לכם, שתהיו אתם הדיינים בדבר, ותקדשו את החודש.

והיות שאין עושים בית דין שקול, כדי שאם יתחלקו הדיינים בדעותיהם לא יהיה מצב שכל צד שקול לחבירו, לפיכך מוסיפים עליהם עוד דיין אחד, והרי הם שלושה. [תוספות, ריטב"א].

ומשנתנו, שאמרה כי הדיינים שראו את חידוש הלבנה יכולים לקדש את החדש, באה

The chapter before us deals for the most part with the laws of the shofar, but the first Mishna still deals with the laws of sanctifying the new month:

Mishna:

The court and all Israel saw it,

the renewal of the moon, on the thirtieth day.

Or two witnesses saw it, and

the witnesses were examined

in court and were found to be true witnesses.

And the court did not have enough time

Gemara:

And we answer:

Just as is the case with monetary laws,

Monetary cases are judged during the day, and

And the Merciful One calls it “judgment,”

that is, the beginning of judgment. To teach you:

Just as “judgment

during the day!

We learned in the Mishna:

And on the following day, when they come to sanctify the new month, they do not see the moon then. Therefore, they need them to testify before them.

We learned in the Mishna:
