גלעד, קרית פועלי און, עקובה מדם
".
ומבארינן:
מאי

עקובה מדם
"?
אמר רבי אלעזר: שהיו עוקבין
אורבים
להרוג נפשות.
ודנה הגמרא:
כיון שהמרחק מהגבול לעיר מקלט שוה למרחק שבין עיר מקלט אחת לעיר מקלט שניה, נמצא שארץ ישראל מחולקת לארבעה איזורים שוים, לענין ערי מקלט:
שני איזורים קיצוניים - מהעיר קדש עד לגבול הצפוני, ומהעיר חברון עד לגבול הדרומי.
ושני איזורים אמצעיים - מחברון עד שכם, ומשכם עד קדש.
הרי מעתה, יש להקשות:
ומאי שנא
, מדוע שונים הם שני האיזורים הקיצוניים של הארץ, האיזור הצפוני ואיזור הדרומי, שהם
מהאי גיסא ומהאי גיסא
, משני צידי הארץ,
דמרחקי,
רחוקות הן ערי המקלט מהרוצחים הצריכים להגיע אליהן.
שהרי אם הרג הרוצח בקצה האיזור שלהן, על גבולות הארץ, בצפון או בדרום - עליו לנוס מהגבול עד עיר המקלט [קדש בצפון או חברון בדרום] דרך שאורכה רבע ארץ ישראל.
ומאי שנא
ומדוע שונים הם "
מציעאי
", שני האיזורים שבמרכז הארץ, בין חברון לשכם, ובין שכם לקדש,
דמקרבי,
שערי המקלט שלהם קרובות הם לרוצחים!
כיון שכל רוצח הנמצא בשני איזורים אלו, יש לו את האפשרות לברוח אל אחת משתי ערי המקלט צפונית לו או דרומית לו, היות שהוא נמצא ביניהן.
וכיון שהמרחק בין עיר לעיר הוא רבע מאורכה של ארץ ישראל, יהיה אורך הדרך שצריך הרוצח לנוס שם, לא יותר מאשר שמינית הארץ,
ונמצא שההורג סמוך לגבול, עליו לרוץ פי שנים מהרוצח בין הערים, כיון שהמרחק שוה ממקום למקום, ובצד הגבול אין עיר מקלט.
ומתרצינן:
אמר אביי: בשכם נמי שכיחי רוצחים

אמר רבי אלעזר
: דברי הכתוב הם בדרך משל:
שהיו מתחברין
, מתאספים הרוצחים בשכם
להרוג נפשות
-
ככהנים הללו שמתחברין לחלוק תרומות בבית הגרנות
.
ובכך מיושב למה הדרך בין הערים קצרה מהמרחק שבין הערים הקיצוניות לגבול. שכן, שכם היתה העיר שבמרכז, ומשני צידיה שכיחי רוצחים. והוצרכו ליותר ערי מקלט לנוס אליהם.
אך לא היו בה שכיחים בה רוצחים כמו בגלעד, ולכן לא הוצרכו להוסיף בארץ ישראל ערי מקלט כמו בעבר הירדן [מהרש"א].
ומקשינן על מה ששנינו שגולין רק לשש ערי מקלט:

האם אי אפשר לגלות לערים אחרות אלא רק לשש הערים האלו?
והא כתיב
[במדבר לה] "ואת הערים אשר תתנו ללוים - את שש ערי המקלט אשר תתנו לנוס שמה הרוצח.
ועליהם תתנו
[עוד]
ארבעים ושתים עיר
".
ומשמע שאף אל שאר הערים של הלויים יכול הרוצח לנוס ולמצוא בהן מקלט מפני גואל הדם.
ומתרצינן:
אמר אביי: הללו
, שש ערי המקלט שבהן עוסקת משנתנו,
קולטות בין
שברח אליהם הרוצח
לדעת
שיקלטוהו,
ובין
שנכנס אליהן
שלא לדעת
, אפילו שלא ידע שהן קולטות, ולא נס אליהן כאל עיר מקלט. ואין גואל הדם יכול להורגו. אך
הללו
, שאר ארבעים ושתים ערי הלויים, רק אם נס אליהן
לדעת
שיקלטוהו, אז הם
קולטות
.
אך כשנכנס בהם
שלא לדעת
קליטה -
אינן קולטות.
ומקשינן על הברייתא בתוספתא לעיל, שמנתה את חברון כאחת משלשת ערי המקלט בארץ ישראל:

והכתיב

ויתנו לכלב את חברון, כאשר דבר משה
".
ואילו בשש ערי המקלט נאמר בתורה שיתנום ללויים, כדלעיל, וכלב הרי היה משבט יהודה!
ומתרצינן:
אמר אביי
: רק את
פרוורהא
של חברון, שהם הכפרים והחצרות הסמוכים לחברון ונקראו על שמה, נתנו לכלב. אך העיר חברון עצמה, היתה עיר של הלויים, והיא אחת מששת ערי המקלט.
וכמו שנאמר ביהושע [כא יג] "ולבני אהרן הכהנים נתנו את עיר מקלט הרוצח, את חברון".
ובסוף הפסוק שם משמע כאביי,

ואת שדה העיר ואת חצריה

נתנו לכלב בן יפונה
".
ומקשינן גם על העיר קדש:

עיר מקלט הואי?
והכתיב
[יהושע יט] "
וערי מבצר
[אלו הכרכים הגדולים שהיו בנחלת נפתלי],
הצדים צד וחמת, רקת וכנרת

וגו

וקדש ואדרעי ועין חצור
".

אילו לגבי ערי מקלט
תניא: ערים הללו
, העומדות לקלוט רוצחים,
אין עושין אותן לא טירין קטנים,
לא טירות קטנות, שאין מזונות מצויים בהן לרוצחים, שאינם יכולים לצאת,
ולא כרכים גדולים
, שנקבצים לשם רבים ויהא גואל הדם מצוי שם,
אלא עיירות בינוניות
, כדי שיהיה מזונם של הגולים שם מצוי, אך לא יהיו שם הרבה עוברים ושבים.
ואם כן איך יתכן שקדש, שהיא עיר מבצר, והיא כרך גדול, תהיה עיר מקלט?
ומתרצינן:
אמר רב יוסף: תרתי
ערים הנקראות
קדש הואי,
ועיר המקלט קדש אינה נכללת בין ערי המבצר שבחבל נפתלי.
אמר רב אשי
: לדעתי עיר המקלט קדש כן היתה בנחלת נפתלי, והיא היתה עיירה בינונית המתאימה לשמש כעיר מקלט. אלא שהיא היתה סמוכה לכרך גדול שנקרא "קדש", כמבואר במקרא לעיל. ובגלל סמיכותה אל הכרך הגדול, נקראה גם עיירה בינונית זו בשם "קדש".
ומצינו כן,
כגון: סליקום ואקרא דסליקום

סליקום היא עיר מבצר גדולה, וסמוך לה נמצא כפר שנקרא על שמה, אקרא דסליקום.
גופא, ערים הללו

אין עושין אותן לא טירין קטנים, ולא כרכים גדולים, אלא עיירות בינוניות
.
ואין מושיבין אותן
, את ערי המקלט,
אלא במקום
שיש בו מקורות
מים,
כדי שלא יאלצו לצאת להשיג מים מחוץ לעיר המקלט.
ואם אין שם מים
כגון ערי הלויים שנקבעו בגורל, בזמן חלוקת הארץ, במקום רחוק ממקור מים, ונקלטו בהם רוצחים,
מביאין להם מים,
על ידי אמות מים, המוליכות את המים מהנהרות הרחוקים עד העיר.
ואין מושיבין אותן אלא במקום שווקים
, כדי שימצאו מזונות לקנות.
ואין מושיבין אותן אלא במקום
שיש
אוכלסין,
באזור מיושב, שיש באותו איזור גם כפרים ויישובים [והמאירי כתב שיש שם גבורי חיל להגן], כדי שלא יתאספו גואלי הדם רבים יחד ויצורו על העיר.
ואם
נתמעטו אוכלוסיהן
באזור שסביב העיר
מוסיפין עליהן
דיירים, ואפילו דיירים עראיים.
אך אם
נתמעטו דיוריהן
בתוך העיר,
מביאין להם כהנים, לויים
וישראלים
שיגורו עמהם, כדי שלא יהיו הרוצחים רוב תושבי העיר, היות שאין העיר קולטת כשרובה תושבים רוצחים, כדלקמן, ולפיכך צריכים להוסיף לעיר דיירים קבועים.
ואין מוכרין בהן לא כלי זיין
שלא יבוא גואל הדם וירכוש כלי זיין בעיר המקלט להרוג בו את הרוצח.
וממקומו לא חוששים שיביא עמו, כי ירגישו בכלי הזיין בעת בואו לעיר.

אין מוכרים בהם אפילו
לא כלי מצודה,
שהורגים בהם חיות,
דברי רבי נחמיה
.
וחכמים מתירין.
ושוין
רבי נחמיה וחכמים,
שאין פורסין בתוכן מצודות
, היות שהציידים מלומדי חרב הם, וכל מקום שמצודות מצויות שם, כלי זיין מצויים שם, ושמא יבא גואל הדם בהתנכרות ויקח לשם כלי זיין [המאירי].
ואין מפשילין לתוכן חבלים
של ציד מאותו הטעם -
כדי שלא תהא רגל גואל הדם מצויה שם.
אמר רבי יצחק: מאי קרא
שממנו משמע שכך ראוי להתקין בעיר מקלט? שנאמר "
ונס אל אחת מן הערים האל, וחי
".
ומשמעותו,
עביד ליה מידי דתהוי ליה חיותא.
עשה לו דבר שיוכל לחיות שם.
תנא, תלמיד שגלה

מגלין רבו עמו!
ואפילו אם קיימת ישיבה בעיר מקלט, כיון שלא מן הכל אדם זוכה ללמוד [ראשונים]. וכיון שהוא צריך לרבו שילמדנו, גולה עמו,
שנאמר
"
וחי
" -
עביד ליה מידי דתהוי ליה חיותא
.
והוסיף הרמב"ם [פ"ז מרוצח ה"א] "וחיי בעל חכמה ומבקשיה בלא תלמוד - כמיתה חשובין".
אמר רבי זעירא: מכאן
יש לנו ללמוד,
שלא ישנה אדם לתלמיד שאינו הגון,
כדי שלא יביאוהו עונותיו של התלמיד לידי הריגה בשוגג, וכשיגלה התלמיד, יאלץ רבו לגלות עמו.
אמר רבי יוחנן: הרב שגלה
-
מגלין ישיבתו עמו,
לפי שאין לו חיים בלא ישיבה [מאירי]. וצריך להתקין לו מה שדרוש לו כדי לחיות, שנאמר "וחי".
ומקשינן"
איני!
למה יגלה הרב שהרג בשגגה?
והא אמר רבי יוחנן: מנין לדברי תורה שהן קולטין
ומצילין כעיר מקלט?
שנאמר
בעיר מקלט "
את בצר במדבר
".
וגו
מר.
וכתיב בתריה
"
וזאת התורה
".
האות ווי"ו מוסיפה על ענין ראשון, ומלמד הכתוב כי כשם ששלשת הערים קולטות, כך התורה קולטת [מהרש"א]. ואם כן, הרב שהרג "קלוט" הוא בתורתו, ואינו צריך לגלות!?
ומתרצינן:
לא קשיא

הא
שאמרנו "תורה קולטת", היינו רק
בעידנא דעסיק בה,
בזמן שעוסק בלימודה.
ומה שאמרו שהרב גולה, היינו
בעידנא דלא
עסיק בה
שאינו קלוט אז, וצריך הגנה מגואל הדם.
ואי בעית אימא, מאי
"דברי תורה
קולטין
"?
קולטים ומגינים רק
ממלאך המוות,
שהוא דבר שבידי שמים, אך לא מצילים ממיתה בידי אדם.
ומה שמצינו שדברי תורה קולטין, היינו
כי הא

דרב חסדא הוה יתיב וגריס בבי רב
.
ולא הוה קא יכיל שליחא דמלאכא דמותא למיקרב לגביה
, משום
דלא הוה שתיק פומיה מגירסא
.
לא היה יכול שליחו של מלאך המות לגשת אליו וליטול את נשמתו כיון שלא פסק פיו מלעסוק בתורה, שהיא עץ החיים, וכל האוחז בה אינו יכול למות.
מה עשה שלוחו של מלאך המות?

והיינו, שעיר המקלט בצר, שבנחלת ראובן, נמנתה ראשונה בפרשת ערי מקלט.
מפני שהוא פתח בהצלה תחילה
במכירת יוסף.
שנאמר
[בראשית לז] "
וישמע ראובן, ויצילהו מידם
".
דרש רבי שמלאי: מאי

[דברים ד] "
אז יבדיל משה שלש ערים בעבר הירדן מזרחה שמש
"? -
אמר לו הקב"ה למשה: הזרח שמש לרוצחים!
הכן להם כדי חיותם וצרכיהם, כאמור לעיל.

הקב"ה למשה שהבדיל את שלשת הערים בעבר הירדן מדעתו:
הזרחת שמש לרוצחים!
שהסכים עמו הקב"ה, וכדלהלן בסמוך.
דרש רבי סימאי: מאי

אוהב כסף לא ישבע כסף, ומי אוהב בהמון

זה משה רבינו, שהיה יודע שאין שלש הערים שבעבר הירדן קולטות עד שלא נבחרו שלש
ערי מקלט
בארץ כנען, ו
בכל זאת
אמר: מצוה שבאה לידי

אקיימנה,
והבדיל שלש ערים בעבר הירדן, אף שלא יכלו לקלוט עדיין. הרי שיש להוקיר אפילו כל חלק ממצוה, אפילו אם אינו משלימה.

למי נאה ללמד בהמון
לדרוש ברבים,
מי שכל תבואה שלו
, שבקי במקרא ובמשנה, בהלכות ובאגדות.
והיינו דאמר רבי אלעזר: מאי

[תהילים קו] "
מי ימלל גבורות ה', ישמיע כל תהילתו
"? -
למי נאה למלל גבורות ה'?
רק
מי שיכול להשמיע כל תהילתו!
וכיון שאין מי שיכול לספר את כל תהילתו, לפיכך אין נראה לספר מדעתו, אלא מה שתקנו חכמים [לשון רש"י מגילה יח א].
ורבנן, ואיתימא רבה בר מרי אמר
ביאור אחר במקרא זה:
"
מי אוהב בהמון, לו תבואה
" -
כל האוהב למלמד בהמון
, האוהב תלמידי חכמים -
לו תבואה!
שהתורה מחזרת עליו ועל זרעו, ויהיו לו בנים תלמידי חכמים.
וכאשר אמרו דרשה זו,
יהבו רבנן עינייהו ברבא, בריה דרבה,
נתנו בו עיניהם לברכה, שמצאו בו את קיום הפסוק, לפי שהיה רבה אוהב תלמידי חכמים, והיו בניו תלמידי חכמים.
רב אשי אמר
ביאור אחר במקרא זה:
כל האוהב ללמוד בהמון
עם חברים רבים -
לו תבואה!
והיינו דאמר רבי יוסי ברבי חנינא
:

חרב אל הבדים, ונואלו
" - תבוא
חרב על צוארי "שונאיהם"
[בלשון הפוכה]
של תלמידי חכמים, שיושבין ועוסקין בתורה בד בבד
, ביחידות, כל אחד בפני עצמו.
ולא עוד, אלא שמטפשין
בלימוד יחידי בלי חבורה.

ולא עוד, אלא ש

ואיבעית אימא, מהכא
נלמד שחוטאין הלומדים ביחידות משום שהם מיטפשים ["נואלים"] -
דכתיב [ישעיהו יט] "
נואלו שרי צוען,
נשאו שרי נוף", ו"נשאו" פירושו "תעו", הרי שהנואלים הם גם חוטאים.
רבינא אמר
ביאור נוסף במקרא זה:
כל האוהב ללמד

, שעל ידיהם ירבה הפלפול ויתן לב לתרץ קושיותיהם.
והיינו דאמר רבי: הרבה תורה למדתי מרבותי, ומחבירי

עומדות היו רגלינו בשעריך ירושלים

מי גרם לרגלינו שיעמדו במלחמה

ואמר רבי יהושע בן לוי: מאי

שיר המעלות לדוד, שמחתי באומרים לי בית ה' נלך

אמר דוד לפני הקב"ה: רבונו של עולם! שמעתי בני אדם שהיו אומרים "מתי ימות זקן זה, ויבא שלמה בנו, ויבנה בית הבחירה, ונעלה לרגל

על כך שבני ישראל מתאוים לבנין בית המקדש ולקיום העבודה.
אמר לו הקב"ה
: [תהילים פד] "
כי טוב לי יום בחצריך

וביאורו:
טוב לי יום אחד שאתה
דוד
עוסק בתורה לפני, מאלף עולות שעתיד שלמה בנך להקריב לפני על גבי המזבח!
שנינו במשנה:
ומכוונות להם דרכים וכו'.
Translation
As it is written: “
Gilead is a city of workers of iniquity, tracked with blood.”
And we explain:
What is the meaning of “
tracked with blood”?
Rabbi Elazar said: They would lie in wait
ambushing
to kill people.]]
And the Gemara discusses:
Since the distance from the border to the city of refuge is equal to the distance between one city of refuge and a second city of refuge, it follows that the Land of Israel is divided into four equal regions with regard to the cities of refuge:
Two outer regions—from the city of Kedesh to the northern border, and from the city of Hebron to the southern border.
And two middle regions—from Hebron to Shechem, and from Shechem to Kedesh.
From now on, there is a difficulty:
And what is different,
why are the two outer regions of the land, the northern region and the southern region, which are
on this side and on that side,
on the two sides of the land,
distant,
the cities of refuge being far from the murderers who need to reach them?
For if the murderer killed at the edge of their region, on the borders of the land, in the north or in the south, he must flee from the border to the city of refuge—Kedesh in the north or Hebron in the south—along a road whose length is one-quarter of the Land of Israel.
And what is different
and why are
the middle regions,
the two regions in the center of the land, between Hebron and Shechem and between Shechem and Kedesh,
near,
their cities of refuge being close to the murderers?
Since every murderer found in these two regions has the possibility of fleeing to one of the two cities of refuge, to the north of him or to the south of him, since he is situated between them.
And since the distance between city and city is one-quarter of the length of the Land of Israel, the length of the road along which the murderer must flee there will be no more than one-eighth of the land,
and it follows that one who kills near the border must run twice as far as a murderer between the cities, since the distance from place to place is equal, while on the side of the border there is no city of refuge.
And we answer:
Abaye said: In Shechem too, murderers are common.
As it is written
Hosea 6]: “
And as the ambush of men of troops, a band of priests; they murder on the way to Shechem.”
And it concludes.
And we explain:
What is the meaning of “
a band of priests”?
Rabbi Elazar said:
The words of the verse are an analogy:
They would gather,
the murderers would assemble in Shechem,
to kill people—
like these priests who gather to distribute teruma in the threshing floors.
And thereby it is resolved why the road between the cities is shorter than the distance between the outermost cities and the border. For Shechem was the city in the center, and on both of its sides
murderers were common. And more cities of refuge were needed to which they could flee.
But murderers were not as common there as in Gilead, and therefore they did not need to add cities of refuge in the Land of Israel as they did across the Jordan [Maharsha].
And we raise an objection to what we learned, that one is exiled only to the six cities of refuge:
And
if
there are no others,
is it impossible to be exiled to other cities, but only to these six cities?
But it is written
Numbers 35]: “And the cities that you shall give to the Levites—the six cities of refuge that you shall give for the murderer to flee there.
And upon them you shall give
additional
forty-two cities].”
And it implies that the murderer may also flee to the other cities of the Levites and find refuge in them from the avenger of the blood.
And we answer:
Abaye said: These,
the six cities of refuge with which our Mishna is dealing,
receive
the murderer whether he fled to them
intending
that they receive him,
or
he entered them
without intending,
even though he did not know that they receive murderers, and he did not flee to them as to a city of refuge. And the avenger of the blood cannot kill him. But
these,
the other forty-two cities of the Levites, receive him only if he fled to them
intending
that they receive him; then they
receive him.
However, when he enters them
But when he enters them
without intending
to be received—
they do not receive him.
And we raise an objection to the beraita in the Tosefta above, which listed Hebron as one of the three cities of refuge in the Land of Israel:
And
if
Hebron—
is it a city of refuge?
But it is written: “
And they gave Caleb Hebron, as Moses had spoken.”
But regarding the six cities of refuge it is stated in the Torah that they should be given to the Levites, as above, whereas Caleb was from the tribe of Judah!
And we answer:
Abaye said: Only
the
surrounding area of Hebron, namely the villages and courtyards adjacent to Hebron that were called by its name, was given to Caleb. But the city of Hebron itself was a city of the Levites, and it is one of the six cities of refuge.
And so it is stated in Joshua [21:13]: “And to the sons of Aaron the priests they gave the city of refuge for the murderer, Hebron.”
And at the end of the verse there it implies like Abaye,
as
it is written: “
And the field of the city and its courtyards—
they gave to Caleb son of Jephunneh.”
And we also raise an objection regarding the city of Kedesh:
And
if
Kedesh—
was it a city of refuge?
But it is written [Joshua 19]: “
And the fortified cities
and the fortified cities
[these are the great cities that were in the inheritance of Naphtali],
Ziddim, Zer, and Hammath, Rakkath and Chinnereth.
And so on
it concludes,
and Kedesh and Edrei and En-Hazor.”
And
whereas concerning the cities of refuge
it is taught: These cities,
which stand to receive murderers,
are not made into small fortresses,
small fortified places, where provisions are not readily available for the murderers, who cannot leave,
nor large cities,
where many gather and the avenger of the blood will be found there,
but medium-sized towns,
so that their food will be available there for the exiles, but there will not be many passersby there.
And if so, how is it possible that Kedesh, which is a fortified city and a large city, should be a city of refuge?
And we answer:
Rav Yosef said: There were two
cities called
Kedesh, and the city of refuge Kedesh is not included among the fortified cities in the territory of Naphtali.
and the city of refuge Kedesh was not included among the fortified cities in the territory of Naphtali.
Rav Ashi said: In my view, the city of refuge Kedesh was indeed in the inheritance of Naphtali, and it was a medium-sized town suitable to serve as a city of refuge. But it was adjacent to a large city called “Kedesh,” as explained in the verse above. And because of its proximity to the large city, this medium-sized town too was called “Kedesh.”
And we find this as well,
for example: Selikuma and the village of Selikuma.

so that the foot of the avenger of the blood should not be found there.
Rabbi Yitzḥak said: What is the verse
from which it follows that it is proper to institute this in a city of refuge? As it is stated: “
And he shall flee to one of these cities, and live.”
