He said (Rabba) [Rava] Rav Nahman said: If he took possession of the hulsit, he acquired the metzula. And we raised an objection to it: It is obvious that taking possession of the hulsit is effective…

אמר רב נחמן: החזיק בחולסית קנה מצולה.
והוינן בה:
פשיטא,
שקנין החזקה בחולסית מועילה לקנות את המצולה
דהא אמר שמואל: מכר לו עשר שדות
בעשר מדינות, כיון שהחזיק הקונה באחת מן השדות, ועשה בו קנין חזקה - קנה כולן !
ומתרצינן:
מהו דתימא: התם
בעשר שדות
הוא
שהועיל הקנין חזקה לכל השדות משום
דסדנא דארעא חד הוא,
שתשתית הארץ אחד הוא, וכל השדות שקנה תשמישן שוה, לכן הועיל הקנין באחת מן השדות לקנות את כל השדות,
אבל הכא
בקונה חולסית ומצולה - אין תשמישן שוה, שהרי
הא תשמישתא לחוד והא תשמישתא לחוד,
והיינו חושבים לומר, שלא מועיל קנין חזקה בחולסית לקנות את המצולה.
קא משמע לן
רבא, שגם כשאין תשמיש שני הקרקעות שוות, כיון שמחוברות זו לזו בסדנא דארעא, קונים בקנין חזקה אחת את כולם.

בית שסוחטים בו זיתים לשמן,
מכר
עם בית הבד
את הים
כלי עגול שהשמן יורד לתוכו,
ואת הממל
אבן נקובה שמכניסים בה עץ ומפרכים בה את הזיתים,
ואת הבתולות
כלונסאות של ארז שמעמידים בהן את הקורה של בית הבד, וכל אלו קבועים הם שם, לכן נכללים במכירת בית הבד.
אבל לא מכר את העבירים
קרשים שנותנים על הזיתים הכתושים, ומורידים עליהם את הקורה כדי לכבשם,
ואת הגלגל
שמגלגלים בו את הקורה להעלותה ולהורידה,
ואת הקורה
שטוענים על הזיתים לכבשם ולסחוט את שמנם, כל אלו מיטלטלים הם, ואינם מכורים עם בית הבד.
ובזמן שאמר לו
המוכר ללוקח:
הוא וכל מה שבתוכו,
שמוכר לו את בית הבד וכל מה שבתוכו,
הרי כולן מכורין,
כל תשמישי בית הבד מכורין עמו .
רבי אליעזר אומר: המוכר
את
בית הבד

מכר את נסרים
הקבועים בבית הבד ומונחים סביב הזיתים כדי שלא יתפזרו לצדדים כאשר מכבידים עליהם עם הקורה.
ואת היקבים
מקום מאגר השמן,
ואת המפרכות
שבהם פורכים וכותשים את הזיתים לפני הכבישה.
ואת הריחים התחתונות
האבן התחתונה הקבועה,
אבל לא
את
העליונה.
שתהליך הוצאת השמן מן הזיתים הוא, שקודם מפרכים את הזיתים במפרכות, ואחר כך טוחנים אותם בריחים, ואחר כך עוצרים אותם תחת הקורה בבית הבד. כמבואר במנחות [פא א].
ובזמן שאמר לו
המוכר ללוקח:
הוא וכל מה שבתוכו
מכורים לך -
הרי כולן מכורין.
בין כך ובין כך,
גם אם אמר: כל מה שבתוכו אני מוכר לך,
לא מכר
ללוקח,
לא
את העבירים
לוחות שמניחים על הזיתים תחת הקורה בשעת כבישה,
ולא את השקין
העשויים משערות העיזים,
ולא את המרצופין
שקים העשויים מעור, שנושאים בהם את הזיתים, שכל אלו מיטלטלים הם, ואינם שייכים דווקא לבית הבד .
רבי אליעזר אומר: המוכר בית הבד

מכר את הקורה
שכובשים בה את הזיתים, משום
שלא נקרא בית הבד אלא על שום קורה
שהיא קרויה בד, והיא עיקרו של בית הבד.

המוכר את המרחץ
הוא בית העשוי להתרחץ בו, ויש בו שלושה חדרים זה לפנים מזה, הפנימי מיועד לרחיצה, ובאמצעי פושטים בגדיהם, ובחיצוני עומדים לבושים, וכל החדרים נכללים במכירה, אבל
לא מכר את הנסרין,
לוחות עץ הנתונים על גבי קרקע המרחץ, שלא ייכוו רגלי הרוחצים מחום הקרקע או שלא יתלכלכו רגליהם ,
ואת הספלין
שממלאים בהם מים לרחיצה,
ואת הבלניות
מגבות, ויש מפרשים ווילונות שבפתח.
שכל אלו תשמישים המיטלטלים הם, לכן אינם מכורים בכלל מרחץ.
בזמן שאמר לו
המוכר ללוקח:
היא וכל מה שבתוכה
אני מוכר לך -
הרי כולן מכורין,
אף כל תשמישיו המיטלטלים.
בין כך ובין כך,
אפילו אמר לו: הוא וכל מה שבתוכו אני מוכר לך,
לא מכר
בכלל המרחץ,
לא את המגורות של מים
בריכות המספקות מים למרחץ,
ולא את אוצרות של עצים,
שמכונסים בהם עצים לחמם בהם את המרחץ.
והטעם, לפי שאין אלו תשמישים המיוחדים למרחץ כמו אלו שנימנו לעיל, כיון שהם משמשים אותו גם בביתו ולא רק בבית המרחץ.

חדר שמאכסנים בו את הנסרים בגמר הרחיצה,
ואת בית היקמין
חדר שמאכסנים בו את הסודרים שעוטפים בהם את הראש מחמת חום המרחץ,
ואת בית הספלים
חדר שמאכסנים בו את הספלים המשמשים לרחיצה,
ואת בית הוילאות
חדר שמאכסנים בו את המגבות או את הוילונות.
אבל לא
כלל במכירת המרחץ
את נסרין עצמן, ולא יקמין עצמן, ולא ספלים עצמן, ולא וילאות עצמן,
שכל אלו מיטלטלים הם.
ובזמן שאמר לו
המוכר ללוקח:
היא וכל מה שבתוכה
אני מוכר לך -
הרי כולן מכורין,
אף כל תשמישיו המיטלטלים.
Translation
He said
(Rabba)
[Rava]
Rav Nahman said: If he took possession of the hulsit, he acquired the metzula.
And we raised an objection to it:
It is obvious
that taking possession of the hulsit is effective to acquire the metzula,
for Shmuel said: If he sold him ten fields
in ten countries, once the buyer took possession of one of the fields and performed an act of acquisition through possession in it, he acquired them all !
And we answer:
Lest you say: There
in the case of ten fields
it is
that the act of acquisition through possession was effective for all the fields because
the foundation of the land is one,
for the foundation of the land is one, and the use of all the fields that he acquired is the same; therefore, the act of acquisition in one of the fields was effective to acquire all the fields,
but here
in the case of one who acquires the hulsit and the metzula, their uses are not the same, for
this use is separate and that use is separate,
and we would have thought to say that taking possession of the hulsit is not effective to acquire the metzula.
It teaches us
Rava that even when the uses of the two lands are not equal, since they are connected to one another through one foundation of the land, one acquires all of them through a single act of acquisition by possession.
Mishna:
One who sells
the
olive press —
a house in which olives are pressed for oil —
has sold
with the olive press
the sea —
a round vessel into which the oil descends —
and the mamel —
a perforated stone into which one inserts wood and with which one crushes the olives —
and the virgins —
cedar poles with which they set up the beam of the olive press; and all of these are fixed there, and therefore are included in the sale of the olive press.
But he did not sell the avirim —
boards that are placed upon the crushed olives, and the beam is lowered upon them in order to press them —
and the wheel —
with which they roll the beam in order to raise and lower it —
and the beam —
which they load upon the olives in order to press them and extract their oil; all of these are movable, and are not sold together with the olive press.
And when he said to him
the seller to the buyer:
“It and everything inside it,”
that he is selling him the olive press and everything inside it,
then all of them are sold,
all the implements of the olive press are sold with it .
Rabbi Eliezer says: One who sells
the
olive press —
has sold the beam
even though it is movable, since it is the principal part of the olive press.

“sea”
mentioned in the Mishna?
It is a talfaha
[lentils], the round vessel [like a lentil] in which they place the olives for crushing .
What is the meaning of
“mamel”
mentioned in the Mishna?
Rabbi Abba bar Memel said: It is a mefarkheta,
that is, a perforated stone resembling a mortar, into which they place the olives and crush and pound them by means of a wooden pestle .
What is the meaning of
“virgins”
mentioned in the Mishna?
Rabbi Yohanan said:
These are
poles
pillars
of cedar with which they set up the beam.
They set up at the head of the winepress two pillars, on the two sides of the winepress, and fix a bar between them; and upon the bar they set up the beam.
What is the meaning of
“avirim”
mentioned in the Mishna?
It is kavshei,
wooden boards that they place upon the olives in the olive press, and upon them they lower the beam; and they are not sold together with the olive press, since they are movable.
What is the meaning of
“wheel”
mentioned in the Mishna?
It is a humarta,
a large screw by means of which they used to raise and lower the beam .
What is the meaning of
“beam”
mentioned in the Mishna?
A beam
the heavy beam of the olive press with which they press the olives.
The Sages taught
in a beraita:
One who sells an olive press —
has sold the boards
fixed in the olive press and placed around the olives so that they would not scatter to the sides when they weigh them down with the beam.
And the oil vats —
the place where the oil is stored,
and the crushers
in which they crush and pound the olives before pressing.
And the lower millstones —
the fixed lower stone,
but not
the
upper one.
For the process of extracting oil from olives is that first they crush the olives in the crushers, and afterward they grind them in millstones, and afterward they press them beneath the beam in the olive press. As explained in Menahot [81a].
And when he said to him
the seller to the buyer:
“It and everything inside it”
are sold to you —
then all of them are sold.
In either case,
even if he said: “Everything inside it I sell to you,”
he did not sell
to the buyer
either
the avirim —
boards that are placed upon the olives beneath the beam at the time of pressing —
nor the sacks
made from goat hair,
nor the marzufin —
sacks made from leather, in which they carry the olives; for all of these are movable, and do not belong specifically to the olive press .
Rabbi Eliezer says: One who sells an olive press —
has sold the beam
with which they press the olives, because
an olive press is called an olive press only on account of the beam
which is called bad, and it is the principal part of the olive press.
Mishna:
One who sells the bathhouse —
it is a building made for bathing in, and it contains three rooms, each one within the other: the innermost is designated for bathing, in the middle one they remove their garments, and in the outermost they stand clothed; and all the rooms are included in the sale, but
he did not sell the boards,
wooden boards placed upon the floor of the bathhouse so that the feet of the bathers would not be burned by the heat of the ground or so that their feet would not become soiled ,
and the cups
with which they fill water for bathing,
and the balaniot —
towels; and some explain that they are curtains at the entrance.
For all of these are movable implements; therefore, they are not sold as part of the bathhouse.
When he said to him
the seller to the buyer:
“It and everything inside it”
I sell to you —
then all of them are sold,
including all its movable implements.
In either case,
even if he said to him: “It and everything inside it I sell to you,”
he did not sell
as part of the bathhouse
either the water reservoirs —
pools that supply water to the bathhouse,
nor the storehouses of wood,
in which wood is gathered to heat the bathhouse with it.
And the reason is that these are not implements designated specifically for the bathhouse, since they serve him also in his house and not only in the bathhouse.
Gemara:
The Sages taught
in a beraita:
One who sells the bathhouse —
has sold the house of the boards —
a room in which they store the boards after bathing,
and the house of the yekamin —
a room in which they store the cloths with which they wrap the head because of the heat of the bathhouse,
and the house of the cups —
a room in which they store the cups used for bathing,
and the house of the curtains —
a room in which they store the towels or the curtains.
But he did not include
in the sale of the bathhouse
the boards themselves, nor the yekamin themselves, nor the cups themselves, nor the curtains themselves,
for all of these are movable.
And when he said to him
the seller to the buyer:
“It and everything inside it”
I sell to you —
then all of them are sold,
including all its movable implements.
